Hi all.

Didn't expect to be posting this.

Last week I bought a used c250d estate. Paid just under £23k

Lovely car. But the COMAND in car entertainment just refuses to work properly.

Initially I thought this was due to the SD card being missing when I picked it up (noticed when I got the car home, and notified the dealer).

However I think its more than that, as various functions which don't use SD card data result in the unit seizing up.

I believe the 30 day right to reject would cover the above.... but could someone confirm?

If I give the supplying dealer the opportunity to fix (my preference), will this affect my right to reject later?

I believe you can reject it within the first 30 days without giving the dealer an opportunity to fix.

If you allow them to fix it then the clock on the 30 days stops. It'll start again as soon as it's been fixed.

It gets more difficult (and costly) to reject a car after the first 30 days. At that point you must allow them to attempt to fix the issue, as long as it's done in a reasonable time with no inconvenience to you.

If the COMAND was advertised as working, then you have the right within the first 30 days to reject the car. But you have said the car drives great and you like it, so I wouldnt just outright reject on that basis. I would call up (dont email, yet) the dealer and be very grown up and adult in the conversation about wanting to resolve the fault. Once you get an agreement you are happy with over the phone send a follow up email outlining what you have agreed, and a letter with the same signed for delivery (this covers you further down the line).

The timer in effect pauses on the right to reject as they resolve the issue. If they fail to resolve it you can reject the car even if it goes past 30 days since purchase.

If you really want to reject it then its within your rights, but it is usually better for all involved to try and resolve the fault - cars are complicated machines and things go wrong from time to time, it doesn't mean you have bought a lemon if they do.

100% this. I've been through the rejection process with a new car before and it's painful and stressful for all parties.

I also have a thread open about my current car and options to try and avoid rejection unless it's the only route.

If you like the car, I'd probably try to come to an agreement to get it fixed.

Being as it's a component fault, let them try to fix it before jumping to rejection.

Rejection should be for a car that has ongoing/terminal issues that are never likely to be resolved or are major faults - not because a perfectly fixable problem has occurred.

If you get grief and hassle fixing the problem, then go to rejection - which you're entitled to do.

Thabks for the replies.

Noticed today the front right tyre losing pressure.

Wouldn't mind however I spotted this and flagged it pre purchase. The dealer mentioned they sometime have issues with mercedes metallic valves... apparently. Sigh.

That was followed by a 50 mile trip on the motorway where the ICE system crashed and wouldn't restart, so a nice drive in silence (but unfortunately missing a planned call).

I sent the right to reject letter when I got home.

If the dealer would swap for a new comand unit and put in new valves would that satisfy you OP?

Just bear in mind you could reject this perfectly good car and go buy a real lemon next.

The valves although frustrating should be an easy fix?

It's under 5 years old (annoying as the tax was over £500, although I'll get some back ill lose out on the first month.

Appreciate the lemon potential for whatever comes next.... not thinking about that until this is sorted though for now.

Tbh having had issues in the past with intermittent recurring faults, I've little interest in keeping the car regardless of fix.

Cracked alloy wheel? My neighbours Merc has gone through several cracked alloys/welded them up.

Well good luck on the rejection, I imagine the dealership will push back/offer solutions first - the CRA is the legislation in place for these things but dealers if they wish will fight it. Hope you get your desired outcome.

Having slept on it, if the dealer can fix it, properly and guarantee the issues are resolved I could probably be convinced to keep it.

I'll wait to see what they say. At least Having sent the letter the ball is now very much rolling.

Not sure of the exact spec/model you have, but my previous company C220d (68 plate) had some early issues with the command unit locking up. I believe it was resolved with a software update and it didn't do it again over the next 3 years or so I had it.

Not sure how you would check what version is on it now, verses what the latest is but might be worth trying to find out from your local dealer. At least that way you'd be able to go to seller and ask them to get it updated if applicable.

This is why I was asking the OP if he got the car from a Merc dealer of Joe's Hot Cars, Back St, Anytown.

These software issues are much better dealt with via the OEM

The missing SD card can hold all sorts of information, licence codes for the SatNav maps, data for which driver’s using the car, comfort & audio settings, etc. if the systems expecting the card, it may be locking up trying to read it.

I’d get that found / replaced first.

If you like the car, you’d be mad to reject it for a software problem and a slow puncture.

The tyre will take all of 10 mins to sort and the ICE thing will also be sorted easily.

Being a Merc dealer, they may be easy about taking it back, but I can’t see the point in going through that faff tbh.
