I occasionally (alright , often) leave my car in a pub car park about 100 yds from me. (90 metres , newbies).

Saturday night , I discovered it missing. One barmaid has told me that she is sure she saw it towed away , and another source has said he has heard an assistant manager say he "knows" it was towed away.

The crew had turned up to take away a legitimate scrapper , and may have left with two scrappers.

The landlord was away on holiday , and the relief don't know anything , so , question , if some jumped up do-gooder staff has said "oh and take that heap of crap as well" , where do I stand ?

If you,re interested , it was a Mondeo , but the extremely rare '93 GLX model :D (but it's the aggro involved that counts)

Don't blame "plod". This was from a private car park so I assume clmpers are to blame. Whoever took your car has a common law responsibility to avoid damaging your car but are likely to charge you an extremely high recovery fee. I assume that they were acting on behalf of the pub management.

It is for reasons like this that the Government is trying to legislate against clampers and their dubious practices.

Hmm. When I say towed , I mean towed and scrapped. Would be theft , yeah ?

Well, if there is a legitimately placed sign, warning that the carpark is for patrons of the pub only, and other cars will be removed, then you are indeed, buggered.

If not, then you should be asking for a brand new Mondeo as compensation for the emotional stress involved with losing half your CD collection and a months worth of polo mints - oh, and your car!

If the scrappers were on a legit call to the Car Park and were incorrectly told which car to pick up then they can make a claim that his appropriation fell within the law in that he had a belief that what he did was right and therefore not theft.

So remedy has to go back to civil Law for damages for loss of motor. Owner against scrapper, scrapper against Landlord.

What is the view of Motor Insurance Co?

Patron ? I'm there every night

They were there to legit pick up 1 car , a red Peuguot , two witness said they left with two cars.

Plus , I don't want the stress of having to own a new Mondeo

For info. on clamping, visit the Security Industry Authority website. Most informative. All clamping outfits have to be authorised, or more specifically their staff do. If they aren't then the taking of your car could be considered theft.

Either way, report it to the BiB first off and see what happens.

Obviously missing car reported to bib an insurance company.

I'll inform the police if it seems likely to have been towed (awaiting a phone call from "chief witness" ()

I would say that if Matey has said "take that other scrapheap away" he has assumed the rights of the owner and effectively commits Theft. Again report 1 Stolen Ford Mondeo to the Police. However proving what was said to the person doing the towing would be impossible unless you have witnesses.
