My brother in law is at our house at the moment, just injured his leg and can't drive, but his car is parked outside (free parking today but he'll get clamped tomorrow) he is the only person insured to drive it. However he has to get it home so if someone else drove it and got stopped by the police, would they get done for driving without insurance? Would the court be lenient?

Why not get someone to drive it who has their own fully comp insurance on their own car? Then as long as they have his permission to drive they can drive his car with third party only cover on their own policy.

Be really careful when doing this. Not every comprehensive policy includes third party cover on other vehicles. Definitely check the small print.

Alternatively have a chat with the people who operate the clamping and see if they will be reasonable.

What has been said above is true, but he is not the only person insured to drive it. Drivers are insured, not cars, so anyone whose policy allows it is covered. Probably too late now but never mind.

Most Courts will disqualify and impose heavy fines for No Insurance.

In many cases, if you have your own FC policy it will often allow you to drive any other vehicle not belonging to you with the owners permission, but it will only be either Road traffic act or third party cover.

In my area, first offence convictions for no insurance are usually 6 - 12 month ban and up to about £1500 fine.
