My neighbour has always been a problem since I have mooved in. I have not had a sensible conversation with her, ever! She is the freeholder (we own 2/3 of a very large house, but her property is at the bottom, therefore she is the freeholder) and believs because she is the freeholder, she "owns" us! No kidding. So far I have dealt with her with a large number of placid faces and responding to her crazy letters by destroying her arguement with logic.

She is a real bully and since moving in we have found out that she has bullied the previous 4 owners out of the building. I will not be bullied.

On saturday things came to a head. She has been charging us more that the agreed amount for buildings insurance which I have objected to. She sent us a letter demanding payment otherwise she would inform our mortgage company and a personal finance company that we have taken out a loan with. She had included full details of the the mortgage and the loan down to the account numbers. There is only one way that she can get these details and that is by intercepting and opening my mail.

This is obviously criminal activity and using it for the purposes of blackmail is also a criminal activity.

Later that afternoon, I was cleaning my car. I had chosen not to talk to her about the letter in any way, just let the police deal with it.

Anyway I was in my drive cleaning the car. She waddled by me, barging me out of the way. My dog (who is very friendly) had jumped on to her wall in order to greet her. She grabed the dog by the throat and threw it head first into the pavement. At which point I get a "little" upset. I did not swear, but I told her to get her fat arse back inside before I break a lifetime rule and hit a woman. At which point she says "go on, then I have you for assult" She then got her boyfriend to intimidate me and called the police saying I was verbally assulting her! I laughed in the face of her boyfriend and pointed out that he is about as intimidating as a wet tea bag.

To this moment I do not know how I was so restrained.

Ok, the next day the plod turns up. I tell him what has been going on and show him the blackmail letter. He promises to investigate. We sat with the copper for about 1.5 hours going through about 10% of the problems she has caused. He says this is a good case for a "harassment order" and off he goes to interview her.

I have now found out that he will not be raising the harassment order, he has not investigated the blackmail or theft of personal data. And he has not done this because "she was crying throughout the interview".

The PC in question was ment to get back to me yesterday. This morning I phoned, only to be told that he was off till late friday, I asked to talk to his superior, he is also off untill friday. I asked Who can I talk to? to which the responce was "is it life and death?"

This is incredible, she is getting away with these crimes, she is packing her bags to go to her holiday home in spain (usually for 4 months) and the police dont bl00dy care because she has cried.

Is this a defence I can use if I get caught speeding?

How can I get the police to do thier job and chase this up?

You might I suggest look at Civil law rather Criminal Law to help you can recomend some very good QC's but they are not cheap.

I have talked to some very good solicitors. My brothers company uses a real rottweiler solicitor. The basic advice was that these cases go on for years and will cost 10's of thausands pounds which I will never see again and probably do no good.

Report her (using the confidential lines) to inland revenue/benefit fraud etc. That should occupy her time.

another personal favourite of mine i hate neighbours who are c*nts..is she jonny foreiner??

when she goes on her four month holiday let me know and i will personally come round and brick up her front door and her windows then i will fill her house with expanding foam....job the done

hopefully, the visit by plod, will have given her a sharp shock and reminded her that she is not above the law. do you know the underlying reasons why she is so keen to be a complete pest? there are nearly always reasons (often petty jealouslies/grievances) behind this and if you can chat to her about it... harder done than said.

I have started the process of getting a PO Box and I have reported her to the benefits people. She is living on benefits since she lost her job 18 months ago. Her income is supplied by the benefits system and she has a holiday house in spain. Makes me sick.

I am really worried that she has stolen my ID details and she has taken loans out in my name.

Still the police are not interested.

Did he say he in not going to investigate the blackmail or theft of personal data, or not "yet" investigating. as he couldnt get any information out of the lady the first time he interviewed her because she was crying

You are right there. The police man did point out that she is incredibly jealous.

Even so, does that justify this type of activity?

Seller's Property Information Form (4th Edition)

Q2.1 Do you know of any disputes or anything which might lead to a dispute about this or any neighbouring property?

Q2.2 Have you received any complaints about anything you have, or have not, done as owners?

Q2.3 Have you made any such complaints to any neighbour about what the neighbour has or has not done?

There are other questions on that form which your seller’s should have completed which would have given them ample opportunity to warn you.

Indeed I tend to ask a question of Landlords if there is any dispute between them and the Tennant, etc.

Seems like you might have been on the wrong end of a fraudulent mis-statement or representation when you bought.

Whole word of trouble in store if you want to go down that route but you may like to write to the solicitor who acted for you on your purchase and ask about what you can do from this angle.

As for the Landlord have you called the RSPCA yet? I would.

As for your contribution towards the cost of the Buildings insurance the proportion of this you are responsible for should be set out in your lease. If not exactly my guess is that 2/3 is fair and reasonable.

Rude-Boy's right; if this has happened before, sellers should have disclosed. While this won't shut the harridan downstairs up, it does mean that if things get really bad, you can sue them for basically lying to you when you bought the house...

He has said that he hasnt asked about the theft of personal data because she was crying. Quite frankly I got the impression that he wants the whole thing dropped and that he had forgotten about it. I also think he is being a samaritan and listening to problems that cloud the issue, not getting the facts.

I have had exactly this with someone who took money for goods and never sent them. They had done it with numerous other people, who also gave statements, we had total paper evidence along with abusive emails, and the police said they would take action becuase it was open and shut.

Did they .

They did nothing, and then didn't even have the decency to let us know they were doing nothing until several of us chased them for progress.

Not suprising some people take the law into their own hands when they realise how utterly innefective the police and legal system are.

Try to keep it out of the courts, its a pointless pursuit that only serves the legal profession.

The sellor has disapeard off the face of the earth. Can I hold his solicitor responsible. Forget that, taking a solicitor to court is not fun. Been there, still have the t-shirt.

I have informed the RSPCA. as there are no long lasting injuries to the dog, there is nothing they will do. I can take civil action as the dog is property, chances of success are slim.

As for my contribution to the buildings insurance, the leasehold agreement states 50%. She has done her very best to hang me using this agreement, so I will abide to it by the letter.

If you have evidence of a criminal act as per this case and the police choose not to pursue the case, do you have any come back on the police for not proceeding with it.
