Normally I'm relaxed about Data Protection, as it's hard to keep control of email addresses etc. But I think I've been pushed over the edge this time and am riled.

My wife had a subscription to a service that would post a box of clothes out once a month. She would choose what she wanted to keep, post the rest back and they would take payment for what she kept. It started off as good value, but the clothing became increasingly expensive so she kept very little.

Last year they pulled out of the UK market and sold the UK stock off at 70% discount.

This morning a box arrived from one of their competitors. This had not been ordered, and checking her email my wife missed a mail telling her that a box was on its way and that she should send anything she did not want back and pay by bank transfer for any that she wanted to keep.

So company A sounds like they have sold her data. Then B has sent goods out on an unsolicited basis.

I'm curious as to whether any Data Protection rules may have been broken here?

I would say it depends if Co B bought Co A or its assets. If they did, they are just carrying on that business.
If Co A still exists and sold the data, not so much.

Has company B bought company A

You may have had a situation where you're still a customer of company A, but with everything now done by company B so it throws you?

I believe company A still trades in the US. I suppose a UK entity may have been sold.

And what is your plan if GDPR has been bent or broken? Report them to the ICO? Sue them for damages?
What would you like to achieve?

Complicate their lives.

I'm less than amused at seeing a box of clothes worth a few hundred quid landing on my doorstep which presumably they would then pursue the cost of if they don't get the clothes or cash back.

It's one thing when I (or in this case the wife) has agreed to it. Somewhat presumptuous when it's just done..

The OPs question was just "I'm curious as to whether any Data Protection rules may have been broken here?

Doesn't sound right to me, im sure there was a company buy out somewhere here.

I'd ignore all knowledge of the email and donate the clothes to charity?

Might it be French and come from their Captain?

If so the UK arm was bought by ex salespeople who 'might' although shouldn't have, kept their lists of customers.

It is however 'almost' the same organisation with a different distribution system.

That said, yes in this case they've breached GDPR, unless, we I expect your wife did, she gave them permission when she ordered from them in the first place.

If there was a purchase of assets involved between one company and another, the fact that they would have access to existing customer base would substantially increase the value of the business being sold, you were in essence an asset to be sold....so would hope they had the correct permissions in place to be able to do this

Does seem a bit rash to send out a few hundred quid of product if there isn't some kind of continuation of the service. Data gets sold left, right and centre, are you sure this hasn't been agreed to in the past, somewhere in the 8 million pages of T&C's we all have to wade through?

This sounds like a service I used to use (I am not sure if I can use the proper website names) but I have received many, many emails about the old company closing and the details being migrated to a competitor.

I have agreed to carry on.

In fact, I have just checked and I received an email on 22-11-23 specifically telling me what was happening to my data with a link provided should I not wish to have my information sent to the new company. I am guessing these have been going into your wifes junk?

Probably...

I'm still not convinced that they should be able to transfer details in an assumptive way, but who knows what she signed up to. Certainly not her!

Surely to goodness there are way more important things to spend time on?

Why not let your wife decide if she wants to carry on with the service? If not, just cancel it and move on with life's passing parades.

I hope the company concerned has a good credit control department because I'm sure there will be a lot of people who just keep the stuff and don't pay.
