So my wife is quite shaken up today.

she was driving around a roundabout in the left lane intending to exit at 3 o clock. The arrows on the road say that you can be in either lane (I know.. probably not the best lane choice anyway) but she was indicating right. Some guy in an M135i tries to leave the roundabout from the inside lane and cuts her off. Small damage to her car but decent damage to his passenger side both rear and front door. Ie he clearly cut her off big time.

He gets out of the car and starts shouting at her for being in the wrong lane (she probably was? but still) - who tries to leave a roundabout from the inside lane and doesn't check if there's a car to his left?

He also said to her "I'm sick of this you're the 3rd person to crash into me in the last 3 months" - not a sign of a good driver...

What do you guys think? What will insurance say? 50/50?

If it's on a roundabout it's almost always 50/50 unless you have dashcam footage, then it's usually 50/50

I heard that yes... Mrs F was clearly in the wrong lane.. But also everybody ends up in the wrong lane sometimes.. So it's a bit annoying given this guy clearly was driving like a total c***.

I think the answer is that she was in the wrong lane, and he was an arse (and not taking due care when crossing a lane - based on an assumption of what the lane markings were). So 50/50.

Yea think that's true. But also he was in the wrong lane too? I mean I admit I have tried to leave a roundabout from the inside lane once or twice but I definitely have never hit anybody bobbling along in the outside lane in doing so because that would be idiotic (cars have mirrors).

Anyway doesn't matter, no claims bonus is a goner.. I just find it quite annoying..

My OH has had 2 claims and 3 other minors in the last 8 years ..i don't dare be a passenger anymore

Wimmen, know your place. It's her fault, they all do it, driving round in the wrong lane.

If the markings say your Mrs could be in either lane, surely the markings for the other lane do not indicate he could take the exit he did?

I had this exact accident when I was 18 or 19.

Except I was M135i man (Astra 1.6 actually), and got caught out by a numpty going right from the left lane. It went 50/50 and I learnt my lesson.

Wrong lane maybe, but it was the BMW driver that consciously turned across her without checking if there was anything in the way.

If you want to leave a roundabout and aren't in the left hand lane, you have to check the lane to your left is clear before changing lanes. He obviously didn't.

I think you missed this important bit of information:

So she was in a lane that permitted her to take that path of direction. Having been in exactly the same position as the OP’s OH several years ago, it’ll go 50/50 even though the other driver was the one who changed lanes without checking it was clear to do so.

Presumably M135i man could be in either lane too. Cuts both ways looking to see who you are about to turn across on a roundabout.

I’ve never seen a 2-lane roundabout with both lanes saying you can go straight or turn right in both lanes; if the left permits turning right, the r/h lane must be right only.

It's a difficult one, OP link to the roundabout so we can apportion blame in true PH style, however if I'm ever where the BMW driver was I always check the drivers side wheel position on the car to my left as that is a really good way of avoiding a crash.

Years ago I managed to get a claim upheld when I went to leave a roundabout from the second lane and got hit by a bus who was in the left lane.

The difference was the bus was in the outside lane which was solely for turning off and he went straight on into the side of my car whereas I had the choice of going straight on or coming off at the junction.

Fortunately the bus driver admitted being in the wrong lane so sometimes you do get 100%. Even then it took a lot of arguing and sending in of diagrams and pictures.

Yes you could say I should have checked before I turned and ideally yes but you tend to believe the lane markings.

So OP I’d say clear markings in your wife’s favour and you have a chance. ‘What you should do if you’re a good driver’ only and you might struggle.

Cars also have the front and side sections made out of see through material.

Even if a driver is in the "wrong" lane, it is absolutely wrong to cut across the front of them to exit, especially if you cock it up and hit them.

Was NCB protected? If not you generally lose 2 years for a claim.
