Without proof of the cost of repair I think you may have a problem

I’ve got to ask, but why didn’t you go through your own insurer when the third party insurers failed to act?

Hi all. I am in a predicament. I had a car accident 1 year ago. The third party insurer admitted liability within a month. I got the car damage estimated at the local Vauxhall garage and repairs were estimated to be around £2500. Car is valued at £12k.

I got a full estimate with the damage photos. I was also injured so I got solicitors and they progressed my claim. My car was damaged, and I wanted the third party to deal with my claim rather than my own insurer. Third party failed to respond to calls from my solicitor for coming to repair my car or at the very least to inspect my car. I waited 5 months and no response from the third party regarding vehicle repairs, so I went and repaired the car privately from a different garage for roughly the same price.

Third party has only started responding now after 1 year. I no longer have the car, and I repaired it privately and had sold it on. I do not have any proof of repair. Third party is asking for invoices of repair.

My question is: 1) What is my entitlement to claim from the third party for vehicle repairs? Can I rely on the Vauxhall garage estimate and damage photos or do I have to have had an invoice from the repairing garage?

2) Is the third party liable for the estimated cost of repair or if I do not provide an invoice, will they not pay at all?

3) Were the third party insurers correct in not co operating with the car repairs?

I know there is case law surrounding this but I wanted the opinions of any savvy insurance guys on here.
Go back to where you had the car repaired and ask them to provide a copy of the invoice you paid.

Back street cash job I would guess.
