Hi guys & gals,

my gf's parents have a small problem with their credit card company that I thought you lot could probably give good advice on.

While they were on holiday in Italy this summer, £400 was withdrawn from a London ATM using their CC and PIN. They live way up north, miles from the ATM in question.

They had the credit card with them, but did not use it in Italy.

The credit card company have told them to basically get stuffed and that my inlaws are responsible for the loss, saying that someone must have taken the card, used it and then replaced it without their knowledge. This is preposterous!

Basically, I would any advice on how to make the CC company see sense...

Looks like a standard response from a downmarket company, the cc mafia do that sometimes. It's likely their attitude will mellow given time and a strongly worded letter to the CEO (cc relevant ombudsman).

You read about this initial response so often these days, then later you read how the credit card company decided that, gosh yes, they were responsible for the loss as they were defrauded not the card holder. It's also in their terms and conditions surely - and this 'we say you pay' attitude seems to be the kind of response you're supposed to give when you've just arse-ended someone and know you're to blame but mustn't admit anything. It's doubtful that this will get anywhere near an ombudsman, assuming that things are precisely as they seem Edited to add, the arse ending refers to a vehicular impact, of course, and the ensuing insurance kerfaffle

It is highly likely that her card was cloned by one of these E.European gangs who put devices/cameras on the ATM machines. I don't know who the liabily strictly lays with in these cases, but I have only heard of a couple of people having problems getting the money back in those cases, most banks refund without (much) question.

Frankly I think the ATM's should be upgraded to the the chip & pin method without delay, although cash withdrawls could be enabled on request for people who want to use it abroad.
