The amount of these I see ripping down the road at 30+ with no safety gear, running red lights, wrong way up a one way ETC is insane.

If the bike is powered by an ICE it is a motor vehicle.
If the bike is powered by an electric motor and is outside of the powered bicycle regs it is a motor vehicle.

Why is there confusion?

If the person was caught riding a ICE powered motorcycle with no registration, approval, insurance, VED, MOT, then the Road Traffic Act applies. No difference if it has an electric motor.

There isn’t confusion. Just as there isn’t confusion when people drive cars with no licence, uninsured, untaxed, on coke, with bald tyres: they know exactly what they’re doing.
