Common Assault.
Discussion
My mate (no really) has just quit his job as a screen printer to become a taxi driver. He's taking some tests and things and now has to take the police check thingy.
A few months ago he got into a little bother in a nightclub where he had an argument with a bouncer.
The upshot of it is that the bouncer took him to court saying that he gave him a poke in the gob. he was found guilty of common assault.
The bloke at the local council told him not to bother taking the check as he would get turned down.
What d'ya reckon.

The serious answer is that it depends what the regulations say. They Council may have some discretion or the regulations may not give them any discretion at all. He needs to ask to see the regulations that govern this to see if it's something that he can try to mitigate his way out of.
My tame taxi driver has a recent conviction for ABH.
I have also successfully defended him twice for other allegations of violence.
So I guess that a spot of common assault is not necessarily the end of the world.
As has already been said, it might have been prudent to sort this out before sacking the day job....

Todays common assault is yesterdays ABH.
Taxi drivers may use prostitues, run thieves and burglars to their 'jobs', move drugs and stolen gear about, touch up drunken women, but they may not have any crime of violence on their copy book.
From what i hear that wouldn't even qualify you to run a taxi firm in glasgow. Some very dodgy goings on there.
Just passing on a rumour if any of these not at all dodgy firms are reading

I resent that sort of shallow remark, your not the sort of bloke that i get in my cab that asks with a stupid smile on his face "Do you ever get woman trying it on with you",i myself have many regulars that are woman that trust me to get them home at the end of the night in what ever condition and i think you will find that sexual assaults are carried out by men Masqerading as taxi drivers,i can only advise that if in doubt only get into a Licensed Hackney/private hire vehicle where the plate is visible on the rear or front of the vehicle.
Never get into a vehicle where you have been approached by a person who asks if you want a cab, this is highly illegal.

Every case is judged on its own merit,i myself dont know what type of person your mate is in much the same way as the guy at the council who your mate saw,No disrespect meant by that last statement.
The council will not issue a cab license to just anyone as mentioned above there are certain responsibilities that a decent person who becomes a cab driver has a duty to do,taking drunk females to their homes and children to school etc.
The only offences local councils and police are strict on are any sexual offences and there is absolutely NO chance of a person being Licensed with any such offence however any other offence is subject to appeal, immedeately or after a certain period of time,so if your mate is serious about going through all the procedure of being licensed he should ask for all rules and regulations to be explained.
Also knowing how greedy some of these taxi Co boss's are it would be a good idea to approch one for help in the procedure with a promise of working for that said person.

Just based on my local press this week and some work done that suggests the biggest users of prostitutes are taxi drivers, and other researchg that says taxis are used by crims to do busines and taxi drivers turn a blind eye for the right tip.

Cheers for that ZR1Cliff. My mate was a bit stupid that night, well, it was nothing really, shouldn't of even gone to court in my view. He had a completely clean record up to this incident and is a completely trustworthy person, I should know, I've known him since he's been about six.

Anyway, what's wrong with prostitutes?

Taxi driver taking a Wigan housewife home after a hen night arrives at her destination. "That'll be six pounds fifty love please"
She lifts up the front of her skirt to show him she's not wearing any knickers. She points down and says" Why don't you just take it out of that?"
"I'm sorry love" he says "Haven't you got anything smaller?"

on this taxi driver thing, bit off topic. i had an incident yesterday when a taxi driver cut me up big time, slammed on my brakes and horn!!!! followed by some choice WTF??? words. anyway he slows down as i pass him (40mph dual carrigeway) he then starts shouting across all sorts of stuff, anyway, heated discussion whilst driving along, he tries to get me to pull over and fight him, baring in mind he DOES HAVE PASSENGERS in his car. Now i have his reg, know his name and that he has a kebab shop in town, (information given by another taxi driver i saw him talking too after walking out of a club last night)
what i want to know, if i make this formal complaint to the council what is the chances they will do anything. he is one of these taxi rank meter blokes, not working for a company with a number on the car.
thanks.

Not sure about the prostitute bit but i was referring to the sexual assualt part and to my knowledge such cases by actual licensed cab drivers are unheard of and like i say are commited by unlicensed driver masquerading as cabbies.
As for the criminal involvement part there are times when you dont know whats going down till you are stuck in the middle of things,eg; one night i picked up a guy that wanted to go to another City and he joked "if anyone asks you are my minder"(i was driving a private hire saloon at the time),we got there and we had to pick up one of the bros that knew what was going down in the area drug wise(i didnt know this at the time) he took me to a right dodgy area where we pulled up down a side street ,he said wait there and jumped out to do whatever, i stayed in my car with his mate,it was pitch black and i was in an area i had read and heard about and one by one all these local hood type bros came and sat in and leaned on the car,,,all of a sudden i had to brush up on my street talk man and chill!,you know what ime saying
...Needless to say i was glad to get out of there with my wad intact ,if these guys had known how much i had on me

I think he should be OK,like i said the best plan of attack would be to find a local cab Co boss who could do with a driver ,be honest and tell the Boss where he stands and use him as a lever,(a cab Co boss should be on close terms with the council)in the long term it would make the application a lot easier for your mate...Good Luck to him.

If youve got his number and have a reasonble reason to complain then contact your local council, chances are his passengers might of already done this.
The council then usually,i have heard, pull the driver in for a chat to assess him,his reasoning and the incident, where usually a warning is all that is normally needed to put the driver in his place and to make him see sense although i have known one driver to be suspended and sent on for Anger management courses, this driver has also had to go before various appeals and is still waiting to get his license back.
