Thames Valley Police - Zero Tolerance on Speeding?

My pal asked my advice on this. He already complete the NIP and this was the response from the Police.

Judging by the paperwork he hasn’t been offered a speed awareness course for 35 in a 30. He advises that he’s never done a speed awareness course previously and has zero points on his licence.

I’d told him to ring the Police force involved and ask why they haven’t used their discretion to offer a SAC on this occasion.

I’m also surprised they even enforced at 35mph in a 30.

While I understand your surprise at not being offered a sac I should point out that 10% +2 is the speed at which enforcement starts, so 35 in a 30

Err, that's not zero tolerance. Prosecution generally starts at 10%+2, which is 35 in a 30 zone.

Yes he's at the speed where enforcement starts. If you mean by zero tolerance the fact that they haven't been offered a course then that is unusual, but could be an oversight so worth a call to ask why. Unless of course he's being a bit economical with the truth about not having already done one.

There is an accompanying part of that letter that will tell him whether he's eligible for SAC

You also need to respond pretty much straight off the bat to be offered it as well. TVP clocked me at 49 in a 40, but as my car is leased, it took months for the ticket to arrive with me and missed the SAC window

I have just comp;let end a speed awareness course this afternoon and the course tutor said that she has had drivers on her course who have only been 2mph over the limit, i was the highest over the limit, 81 in a 70.
Also the lady doing the course was very pleasant and not condescending at all.

I found it interesting as this confirmed something I was wondering about.

I read an article from a guy that had compiled a list of tolerances by county and said that the police/cameras could penalise on or after the 10% +2mph.

Having never been caught on the fringes I wasn't sure, is all.

I had the opportunity for a SAC for 35 in a 30. It was a minor miracle as that was uphill in a diesel Discovery 3. I should have been given a medal really.

Steve2, people get upset here if you say stuff like that. I got incredible lashback from someone claiming to be a speeding lawyer because someone on my SAC said he got done for going 31mph in a 30mph zone, and the instructor backed him up, once he heard it was in a tunnel under the Thames.

Apparently some guys wife’s friend ‘claimed’ to have been done for the same. Of course, she must be the most delusional woman to ever walk the planet!

You will note from the speed table that the course is not available until the minimum speed of the speed limit +10% +2 mph is reached.
So there will be nobody on a course at a speed that is lower than those speeds.
This rule is strictly adhered to.
I am not surprised some of the ADIs who deliver the courses get taken in, but as none of them are remotely involved in enforcement operations, why would they know anything about thresholds operated by the police?

To be honest it's technically a bit odd as a tolerance in any other sense is something you need to lie within or on. I confess to not knowing the rules as they're irrelevant to me, but found this interesting as being fined for adhering to the tolerance was not what I'd expect. I'm being a nerd but they should really change it to 10% + 1mph

But in the OPs case, just suck it up. You play with tolerances and you have no legs to stand on if you get caught.
