My gf and I went on holiday recently and suffered food poisoning on our last day. We've exhausted the complaints process of the package holiday provider and they are refusing compensation based on us not having medical evidence and have offered a £100 holiday voucher instead. I had to take a day off work to recover and the only other information to support our claim is all on their side (hotel reception staff, flight attendants, potential complaints from other guests).

For context the holiday was a week half board in a five star hotel.

I don't believe there is any chance the source of the food poisoning could have been from anywhere other than the hotel buffet.

My options are:
1. Take the £100 voucher and move on
2. Raise it with ABTA.
3. Raise a section 75 claim with the credit card company the holiday was bought on.

I'm wondering if anyone had had success with options 2 or 3 in similar circumstances and what level of compensation I might be able to expect.

You had to take a single day off work due to it?

honestly, take their offer and get on with your life - its to short to worry about where a bit of sickness came from

Ive never claimed a penny off anyone for food poisoning. st happens. Literally sometimes.

Getting the sts is part of travel. Thing is you are used to certain food and a change can cause issues. Hell even sea water

"Holiday tummy" used to affect most people.

Food poisoning put me in bed for 2 weeks before I had an emergency dr, I honestly thought I was going to die and at that point did not care if I did.

A lot of bad stomachs are put down to food poisoning but unless you have the poop tested before any meds you might not know.

The compensation was I lost the belly fat I needed to lose.

Did you have any medical treatment? Stool samples? Any pathogens found, such as salmonella?
Did you eat/drink anything outside the hotel?
I used to deal with such claims, mainly against one package provider, they defend them heavily
Look on trip advisor to see if any other complaints

We tried S.75 claims when Thomas Cook went bust but no chance unless you have medical evidence to show that illness 100% caused by food or drink in hotel

Edit, I see you were half board so you must have eaten outside hotel

Buffet you say? Could have been anything then. Any other guest could have been the source. It’s part of travelling.

Take the money and move on.

I'm proud to say that I've had the screaming sh!ts staying in 5-star hotels and eating at top restaurants right around the world, from Mexico City (memorable gut-ache) to India and beyond. As said above, it's part of the travel experience

Not saying you didn’t have it but food poisoning is most likely to knock you out for more than a day too, when I had it I was in bed for over a week and went to hospital.

It could be a many things that caused it so u less you have evidence this was the case you can look to your travel insurance or take the £100 and move on.
