I've been caught doing an average of 105mph on a dual carriageway. Had no points in 16 years of driving but have also been caught twice on speed cameras (3 points and fine each time) in the last 2 months.

So what do you reckon they'll do? 6 month ban? 12 months?

Any experience / advice appreciated.

Jix

PS I'm gutted.

PPS Yes, I was a twit for doing 105.

You'll probably get disqualified for the offence itself, which could be a 28 day ban, or thereabouts.

You might be lucky and get 14 days, or unlucky and get 3 months.

After the ban you would still have your existing six points for the balance of their three years.

A miserable magistrate would just give you six points, rather than banning you for the offence itself.

You would then reach 12 points under the totting scheme and get a six month ban, unless you can run exceptional hardship.

At least this way your licence would be clean at the end of the ban.

Fine will be £200 upwards, probably about the £500 mark.

Cheers

Big Rons new girlfriend in E wing, or more realistically a 6 month ban and few hundred quid fine. Worth being anal about the proceedures in case they mess up the paper work at some stage. Pepipoo.co.uk seems the best place to ask questions but don't beveal any specific info about the case as they are watching!

A Brief will reduce a ban, but you got to pay for him of course. Unfortunately 105 on a dual track, ie not a m'way doesn't look so good, so you might need that brief. Note that some courts have removed the facility of duty solicitor to motorists.

105 wouldn't go down well on a motorway either.

Banned 28 days probably, depending on magistrate and county. Will be the longest month of your life.

BTW why only 105.

Fk off - I don't need any preaching from you or anyone else. You have no idea of the circumstance or anything else. Give your PC shit to someone that gives a toss what you think. If you're joking then still fk off.

This is getting very childish but who the asked you?

I'm feeling very, very low right now and I don't need any shit - I'm just asking for people's experience, not a load of grief. If you're looking for a row, go elsewhere please.

This is not necessarily true.

An eloquent solicitor who knows his local bench will certainly help.

But criminal law is poorly paid and in consequence, the quality of a lot of the solicitors is depressingly poor.

If you do intend to instruct a solicitor, it might be worth your while to pop down to the court and chat up one of the ushers to get a recommendation.

If you are employed, get a nice letter from the boss explaining that you need your licence for work and can any ban be kept as short as possible.

And don't forget to switch your phone off when you go into court...

Was your driving safe in your opinion Jixi, and what were the road and weather conditions. These are important factors when mitigating the offence. Were you concentrating on the conditions and using COAST (Concentration Observation, Anticipation, providing Space and therefore Time to react).

Was it an average over a distance or a snapshot on laser. If the latter you could argue it was the upper range of your speed, the detection (possibly) having taken place at a location where speed can drift upwards.

Explain that your job depends on your licence, and it goes without saying you'll learn from this lesson at court.

Often honestly explained mitigation from yourself is better than the tried and tested ( but somehow disingenuous) pleadings from a solicitor.

If you feel you can carry that off without getting wound up, or tongue tied, then might be worth a try.

If you do get lucky at court, then learn from it, and lighten that right foot - please!
May not make you any safer, but it may keep you paying income tax!

Hi,

The magistrates recommendations are such that 6 points would be the maximum for speeding. They would most likely give that for the offence, unless they decide to give a ban for the offence itself. As someone had said before, as in my experience it really depends on the mood of the magistrates as to the outcome.

What you should aim for, ie, your best case scenario would be based on how much you need your car. For example if you work from home a 28 day ban could be lived with, but if you have a 50 mile trip to work each day, that needs to be worked into your gameplan too.

I can recommend a couple of solicitors if you mail me, which dependant on your financial and work situation may be in your best interest.

There is also the case that you may be able to successfully plead not guilty. There are also solicitors for that too, but I would not divulge details of the case on here if they may be seen to be incriminating as the CPS *have* in the past reviewed sites like this and Peripoo and used what has been said in evidence against you.

Apologies for being a pedantic Twat, but the sentencing guidelines for over a ton, particularly off the M Way, suggest a disqualification rather than 6 points.

In the case of the unfortunate fella who started this thread, his best result probably involves a short ban for the offence, rather than the points, cos a six pointer is going to tot him up and earn him a six month ban.

He needs that Brief who gets all the footballers off. Probably expensive, though.
