Hi all,

I live on an estate with a privately owned road which was built about 8 years ago. The houses are still covered by the 10 year NHBC warranty.

Part of our block paving road is sinking. We currently don’t know the cause but have been told that the area needs filling with aggregate and re-laying. It’s about 3m wide and dips about 20cm in the lowest section, so will be about £3-4k to fix.

Does anyone know if communal areas of estates are covered by the 10 year NHBC warranty? I don’t have the original documentation, and can’t find an answer on their website.

There are 20 or so houses who collectively own the road through a Managing company.

NHBC only covers structural issues on a dwelling in years 2-10.

Even then they will try and avoid paying anything.

Our management company is on responsible for the public open spaces.

The roads have not been adopted despite the developer doing remedial works.

The roads i believe are still owned by the developer, waiting for the council to adopt.

Have you ever been notified the road is your responsibility ?

Thanks all. Yes- the road and another plot of land was transferred to the Management company around 2016.
