Personal injury on unadopted road
Discussion
Evening all.
I wasn't sure where to post this.
Someone close to me tripped up on an (from what I can gather) unadopted road. They did themselves a number, having tripped up on a very well disguised speed bump and broke 2 ribs and shoulder. Is there a point of liability in cases like this or is it a case of c'est la vie? How can I get total clarification about the status of said road?
Thanks.

Think you're going to need to give more info
If the road is unadopted / private is public access allowed ie should they have even been there
Unadopted is not private. Quite within their rights to be there but I’d suggest if you trip over a speed ramp, there’s only one person to blame. If the road is unadopted / private is public access allowed ie should they have even been there

Liable for what?
If you walked along a public path and fell down a manhole which had rusted though, whose fault would that be? *disengage devils advocate mode.Sadly no compo face photo.... I am asking purely out of curiosity more than anything.

How well disguised was it to cause that level of injury? Did it get up and give your friend a kickin while they were down for good measure? :hehe (hope they make a speedy recovery)I wasn't sure where to post this.

My mum did exactly the same but broke both shoulders as she had her hands in her pockets and swan dived to the floor. Hope your mate recovers well, mum was immobile for several weeks but recovered fully.
It never crossed her mind to sue anybody as she accepted she wasn't looking where she was going and tripped on a rock.

How exactly can a speed bump be disguised well enough to be invisible to a pedestrian?
Sounds like they need to pay attention to where they're going and take some responsibility for their own actions.
They have done. This is purely a thread of curiosity. Sounds like they need to pay attention to where they're going and take some responsibility for their own actions.
Dark, unlit road with no white markings to suggest a speed bump. Very easy to make them “invisible”.

This sort of thinking gets my goat!

Apologies for not agreeing with you, or maybe taking this thread in the way you intended, but your OP is unfortunately an example of a way of thinking that is causing a bigger and more widespread problem than compo for tripping over.

A torch might be a good investment if you're a bit unsteady on your feet and want to go wandering down dark unlit roads. Dark, unlit road with no white markings to suggest a speed bump. Very easy to make them “invisible”.
Expecting all "hazards" to have white markings is likely to result in no end of mishap!
