Got this charge for parking outside of a marked bay. I parked out of the marked bay as the bay I obstructed was already obstructed by construction fencing and I wanted more room to get a toddler out of a car seat who was with me. My argument is that if I had parked within the lines, another car would not have fitted into the bay I obstructed.

Worth appealing or bang to rights because I wasn't within the bay? Thought I would ask before I just pay.

If you wanted more room to get your toddler out, why not park within the bay by reverse parking, you would have had 3/4 of a space to use?

From my viewpoint, I would say you are 100% banged to rights, you were "parked outside of a marked bay" as charged.

Whilst I sympathise with your rationale, the above is what you should have done

Don't disagree with any of this, it's not obvious from this picture but the bays opposite these are quite close so to reverse in you would need to reverse into the segment from the main road or do a several point turn.

I thought there was something along the lines of there having to be some sort of loss or inconvenience caused i.e by me parking like that I have taken up a space someone else could use. In this case I don't think I have.

Smart car could have got in the space had you stayed within the lines but you used up that space.

Funnily enough when I was writing the OP I was going to say that I don't think even a smart car would have got in the space. Picture 2 shows this clearly I think. A G-Wiz maybe, a motorbike definitely.

Although looks like the car next to you managed it, albeit it's a smaller car.

Appreciate it seems like a petty ticket but I don't think you have a valid reason to challenge.

Yeah a Vauxhall Adam is a bit smaller than V60 cool, also has the option to drive right to the end of the row and reverse into space, can't do that with the last space.

So:

(1) Was the ticket received within 14 days (inc BH & weekends) of the infraction date? If yes, go to (2), if no, appeal as the RK saying they can't pursue you as the RK under POFA. They'll email back and say they aren't pursuing you under POFA to bamboozle you

(2) Appeal as the RK, tell them you are not required to name the driver and will not be doing so. Ask for a POPLA code and appeal there. NEVER appeal as the driver.

I don't see any grounds for appeal, you're outside of the marked bay. Whether the next bay is usable or not isn't really relevant to the charge.

FWIW, I'd have parked exactly the same as you.

never say who was driving & post up here a copy of the sign which sets out the terms of parking

Appeal, complain, and generally make a nuisance of yourself. Private parking company? fk 'em. Irrespective of whether you're in the wrong, make them spend effort and man hours on pursuing it.

Appeal, state your reasoning and don't have a kick off. Nobody wants to help someone going off their heads.

Their argument may be that a motorbike may have been able to use that space but now can't do that as comfortably now.

Exactly this, you have cost them money.
A motorbike could have used that space then they could have ticketed the motorbike for parking in a car space.

FFS private parking charges should never be paid. It is so easy to get off every single one.
