Hello

Am considering a car which is being sold by a trader on behalf of a client of theirs, so they are acting as a broker.

How does this affect my rights, does anyone know, in terms of is this a private sale, or a garage sale, Sale of Good Act, etc? Car is an bmw m5, approx 16 years old in case that matters. All I could find via search was buying a new car via a broker. Maybe its the same.

What does the broker say? I suspect that if they are just a selling agent of the owner it will still essentially be a private sale. That's certainly the safest assumption!

They responded by saying they can put a warranty on it, 12 months, at £600.

If they're a dealer, they're a dealer, no? Not that i'd want to rely on that come shove to push. That said, is any small dealer worth the premium when buying a car vs. a private sale. Pay your money etc.

tbh I would not be buying the car if its a private sale, or at least not at the price advertised. Haven't view it yet or spoken face to face, just emails, so i'll suss them out when i visit. Just wanted to be aware of rights etc.

I don't know the answer but I was in a similar position around 6-7 years ago, I went to look at a W204 Mercedes C63 AMG, when I got there it was a dealer on a small industrial estate who seemed to be selling most of if not all the cars as sale or return but the car I was looking at they were very keen to point out they were selling it on behalf of their photographer and they were acting as a broker. I got the distinct feeling they did not want to be associated as the seller of the said car.

They were open to me having anyone inspect the car but clearly wouldn't have been easy to deal with if there were any future issues. I walked away from the car because it seemed a lovely thing but I was uneasy about the circumstances. I'm not sure what the legal standpoint is in these situations but I think it's best to consider that if something does go wrong you should either consider it a private sale or accept you will have a battle on your hands to get the dealer to take any responsibility.

If the Trader invoices you for the car then retail sale, if they introduce you to the owner then private sale.

Not unusual for dealers to have stock SOR
