Accident with a car pulling out - options pls?
Discussion
Hi,
On Thur, a car pulled out from a road, whilst I was riding my Dogma F (2023) and I ended up going over the bonnet and landing in a heap.
It was unexpected and no time to brake or manovera out of the way, with the bike hitting the front wing, side on and damaging it quite badly.
I was 500mtrs from home so with the help of my wife got myself to A&E who were brilliant. I have a concussion, 2 broken ribs and a broken collar bone.
I managed to get the ladies phone number, car reg etc and she has already contacted her insurance company.
I am not to bothered about personal injury claim tbh. However, I would like the bike back together and working as it was. I bought it from Lower regents, London and paid a premium (13.5k).
I am not really sure how to purse this, people have suggested CAMS(?) however they have also said it has taken 2yrs to get paid out.
As I said I am not bothered about personal injury claim but I can't afford another Dogma F whilst I wait to get paid out.
I don't have any bike insurance, I have house insurance I believe however not sure what it covers.
Has anyone been in this situation, could you offer the best possible way forward?

With a bit of luck you will have legal cover with your house insurance, you can use that to manage the claim for you.
My wife was involved in a similar accident and managed to get her bike repaired by a carbon repair specialist at the insurers expense.
Oh and you have significant injuries that are directly the fault of the driver, you absolutely should make a claim for them along with all other out of pocket expenses, loss of liberty etc as this is why the driver has insurance.

You claim directly off the lady's insurance.
You'd also be MAD not to pursue for the injuries sustained as you at this point don't know the long term issues that may arise.
TAKE PROPER legal advice.

I don't know if you can now join and benefit.
They name Fletchers solicitors as their legals.

As I said you would be MAD not to claim for your injuries. They aren't minor and you are not doing the lady a favour by not claiming as you claim off her insurance.

I don't want to be one of those guys who claims whiplash money on every fall or anything.
The consensus seems to be telling me I should claim however.
But what about the bike? How do I get my bike repaired or replaced quickly.
The value can be easily proved, I have a purchase receipt and over the years it's been well serviced and looked after. It's my main bike.
I will give Saga a call tomorrow and see whether it's better to go direct to through a solicitor or CAMS.
I'm very lucky to have sustained no other injuries TBF. I landed on my head and shoulder which took the brunt of the force.

Change the context.
“Whilst at work someone else didn’t follow the rules and was inadvertently careless causing me to suffer a concussion, 2 broken ribs and a broken collar bone.
Also my £13k bike is broken.”
Claim.
The lady who hit you feels terrible no doubt, and her insurance will already be increased due to an accident & the bike cost.
An extra few thousand pounds to ensure you get private medical after care & are covered incase there is a long term issue you can’t see at this stage isn’t going to make her feel worse.
It isn’t going to make her future car insurance cheaper.
It won’t affect the bottom line of some huge insurance company.
It will make a big difference to you.
Ending up broken on the deck isn’t poor form.
Claiming 9 of your relatives were in your 7 seater car when they weren’t and you sustained a minor rear end bump is.
Claim.

"I don't have any bike insurance" - You're riding a motorbike on public roads with no insurance? Or do you mean you have 3rd party only insurance? On Thur, a car pulled out from a road, whilst I was riding my Dogma F (2023) and I ended up going over the bonnet and landing in a heap.

Believe it or not it's a pushbike.Bike insurance is crazy expensive once you go above the free limits available on your household policy. My Cervelo Caledonia would have cost more than both my cars (so I’m self-insuring). And the policies usually come with a bunch of restrictions that mean they wouldn’t be any use in this situation.
In this case, the incident seems pretty clearly due to the actions of the driver who does have insurance. Household insurance may well cover legal costs of pursuing the driver if necessary. Or maybe membership of a body like CyclingUK?

Pretty certain an accident with injury MUST be reported to the police.

Yup 3rd party insurance and legal advice is included with British Cycling and CyclingUK. £50 a year.In this case, the incident seems pretty clearly due to the actions of the driver who does have insurance. I found Laka insurance not too bad for 'comprehensive' cover, comparable to a car. Good cover too.

By the driver yes. Not a bicycle rider. Also the driver does not need to report to the police if they stop and supply their details, and also where there is injury show insurance certificate.https://www.police.uk/advice/advice-and-informatio...

Yes, I joined CyclingUK (it's effectively what was previously the Cyclists' Touring Club) largely for this reason. They have a 25% discount on membership currently, too. British Cycling seem more competition oriented if that's your bag for the similar benefit. Also to add my vote that the OP should claim properly. It's a genuine claim for a proper injury, you're not some ambulance chasing chancer.
Quick update, bike has been collected by my mechanic so see what's what.
And I have contacted the parties insurance company. She had contacted them and they were trying to contact me but due to injuries not been aware.
Really still not sure whether to go through their insurance or a 3rd party solicitor or CAMS.
Collarbone broken
Broken ribs
Concussion
A few scrapes and bruises
...but apart from that, not to bad. Just need to get over the injuries and back to training.
Really annoying, I did 129.9miles on Good Friday from London to Bham, without any issues. This was 500mtrs from home.
