Visited Starbucks at the Metro Centre the other week and the traffic coming out of the drive thru was mayhem.
At the time I pulled out of the drive thru and onto a box junction as others were reversing out of parking spaces.

Today I have received a fine for 'parking' from UKPC, is there a way that I can appeal this?
I don't really think a £60.00 fine is correct for being stuck getting out of a car park.

Any help appreciated.

The PCN alleges that you were parked in the yellow box. If you weren't parked but simply stationary then the offence did not occur.

It's notable that the PCN is not for entering / stopping in the yellow box, but I presume that private companies cannot lawfully enforce yellow box offences in the same way that councils do.

Don't identify yourself as the driver, follow the appeals process and say that no contravention of the T&Cs occurred as the vehicle was not parked. Make sure you ask for all of their evidence including the footage immediately before and after which will show you were not parked. If they reject your claim, go to POPLA, if they reject your claim wait for some threatening letters which you should ignore and then go through the court process.

Also in parallel ask Starbucks/Metro Centre to cancel the charge.

ETA the landowner should have a grace period to allow you to read the T&Cs. Which will be longer than 1m6s.

Just to close this, as posted above, I emailed Metro Centre with some notes on what is classed as 'parking' and how long I have to read the signs.
The fine has been cancelled.
