Mates a mobile engineer in a van running around doing alsorts. Question came up on his travel to and from work. Meaning home to 1st job and last job to home.

Does travel count as his work. Should he get paid from when he leaves home or when he gets to his 1st job.

Some may say paid from the moment of leaving home, others may say a reasonable amount of travel is not paid for, like a commute, others may say from time of arrival at first job. Often dependent on distance to work 'patch'.

The working time directive and whether your mate's employer is required to pay him for travel aren't connected.

As posted above paid (or not) travel is a contractual matter

Travelling time when the employee has no fixed place of work counts for the working time directive

The travel time can be included in the overall calculation of hours worked, but there's no obligation to pay for the travel time. (Which means nothing if the employee is opted out of the Working Time Directive)

As said above, what is paid depends on the contract.

For example, we deemed the first and last half hour of a day was their commute time, and not payable. They won some, we won some, but on average it was about right.

When I worked in a smaller family business, the mobile workers had it written into their contracts that they should be at their first job around the time the premises was open. On a busy day they'd work their hours but more often than not it was job and knock and Friday's were always POETS days. It's probably different in a big corp offering the same services, though.

No mention of travel time? I have yet to see a mobile role JD with no mention of the travel.

In one of my previous jobs I was based at home but would travel to clients sites (1 to 5ish sites a day). I was contacted to 47 hour week but that included travel in it. If I got caught in traffic or left home early I would just finish early another time. I know other companies in the same sector did things differently with travel time not paid at all.
