Ive had an NTK from Parkmavern as the RK to say that there is no valid parking session and time in car park was just over 4 hours.

I know from the driver (and from the use of a tracker) that this is incorrect. The driver entered the premises on the time specified, but left 15 mins later (08:45). They then returned to the same car park at lunch time and left at the time stated in the letter but its managed to say that this is one parking event rather than 2 separate parking events.

It seems the NTK has been sent in the correct time scale but the pictures are very unclear, and the ANPR is inaccurate as it hasn't picked up that this is two separate parking events.

Very frustrating, as the driver has actually complied with the parking regs but I can't prove this.

Do the driver have any recourse here? from what I've read, the photos have to be clear (they certainly aren't) and the ANPR is not accurate!

You say you have no evidence, but what about the tracker you say there is?

My daughter had this last year with her boyfriend, visited the local co-op twice in a day but just registered the first in and last out meaning 6hrs

He wrote a signed statement confirming what happened together with the 2 receipts and the fine got waived.

Yep, happened to one of my friends about a month ago. Registered them going in on a Monday, not coming out and then when they popped back Saturday it picked the car up leaving and a few days later a notice for a 6 days parking fine.

They didn't really have much 'evidence' (amounted to receipts from Costa and Boots) but contested it, and they dropped it almost immediately before they submitted anything.

Most these private places in my experience will back down with a bit of a shove anyway.

Is it a car park attached to a business like a shop? Getting them to cancel the ticket is usually the best approach. Otherwise, follow the appeals process, ask for the partially-redacted ANPR data from the times not caught by the camera, etc.

I had the same at a McDonalds when I used their drive thru first thing in the morning and then later that afternoon. Luckily we have cctv at home, so I just took a screenshot shot of the car parked outside our house during the period I was supposed to have been at McDonalds and sent it to the parking company. They replied saying no further action a few days later.

It's from the Life360 tracking app. It doesn't show who it was or what car but confirms the entry and exit times from that area but I'm assuming the parking company could say that could be someone else or the times doctored but it's something at least. Driver was obtaining breakfast/ lunch on these occasions so would have bank statement to confirm that.

Between these times, the car was at the college down the road and not actually parked in their car park as stated.

Yes, as above, I might speak to Greggs and see what they say also.

I'd just use that, send it to them and they'll almost certainly back down.

I'll give that a shot along with bank statement showing transactions and times.

From experience these parking companies don't usually back down unless you get them on the outside the 14 day period so can't hold you liable but in this case, the parking conditions have been met and no crime has been committed here so I'll go with the honest approach and see what response I get.

I may have too naive a view here. You have reasonable evidence and testimony that the parking co is in the wrong. If they accept it, great. If they refuse to, then the onus is on them to take action and they'd almost certainly lose on balance of probabilities.

True.

I'm fairly sure the college has car park CCTV as well but how long they keep it I'm not sure so that could be another course of action as the car would be parked from 09:00 until 12:00.

I'll appeal tomorrow morning and also say depending on the outcome of this appeal, I can also contact the college for their CCTV.

The driver who parked at the college could make a GDPR subject access request for the college's CCTV that shows them (assuming they are in the car). It would be best to do so ASAP.

That's a much better appeal letter than I had put together so I'll amend that and send that, thank you very much. I'll just add that I have tracking information (and I'll provide it) that shows the stay was not 4 hours long.

I'll let you know how I get on but thanks for that link. Makes things much clearer.

I've had similar at a local tescos. Presented the tracking data from Google maps and they cancelled the ticket.

OP, you don’t need to worry about this at all.

I had exactly the same a couple of years ago, after two visits to Tesco in one day.

I contacted the parking company, explained the issue, and they cancelled it straight away.

What I will say, is that had I have known they breached GDPR and data handling laws at the time,I would have taken it upon myself to peruse them for compensation as suggested in the excellent link provided by Balham123.

It seems very unlikely that the ANPR missed the first exit and also the second entry. They should be able to check their data to confirm, although that's not in their interest. More robust software should stop the issue arising in the first place.

The car park apparently has two entry points and two exit points. A front entrance and a back entrance. Entry 1 was through the first entrance and exit through the back entrance and then same again at lunch time. I'll post with the outcome.

Plus if you are passing do ask Greggs if they can cancel it, assuming that you went to Greggs.
