I have already made direct claims with BMW Finance. On hearing last week that the claims can go back to 2007 I thought I’d check online to see if I could find earlier agreements. This took me to the website of a large firm of solicitors, let’s call them Spectator and Gormless

I put a few details in and the site apparently found some old finance agreements. Anyway I clearly made a mistake as S&G have now opened claims on my behalf which I really don’t want. Their telephone line is ‘manned’ by a robot who advises writing to them by email. I see from the terms & conditions that I have 14 days to cancel and I’m well within that time. I’ve sent 4 emails now without response. I’ve also written to BMW Finance asking them not to give S&G any information as they’re not instructed by me.

I know it was my own mistake but I’m getting peed off with S&G. Anything else I should or could be doing?

Keep records of every contact and attempted contact. Take screenshots. Retain copies of all relevant terms and conditions. If it goes bad report them to the SRA

When have you tried contacting them?

If today, there won't be any solicitors working at the weekend.

Wednesday, Thursday and Friday last week.

Send them a tracked/signed for letter stating it was an enquiry and not instruction.

I once asked to see written terms and conditions from a law firm and it did not constitute instruction. They then sent me numerous communication stating that congratulations acting on my behalf etc.


I emailed, rang (got someone's name and recorded the call) and wrote to them stating this all.

It worked.

Pretty sure these can be checked via Experian or similar without signing up to dodgy claims handlers.

You can just write to the finance company asking them. I think there is a template either on Resolver or Moneysavingexport.

That’s exactly what I did but I wondered about some agreements from longer ago hence searching online.

I have 4 claims registered with BMW Finance so I’ve emailed them asking them not to divulge any details of those agreements to S&G.

I think you are expecting S&G to be rather too efficient and equally you haven’t given them that much time to respond to even your first email.
Assuming that their T and C that you signed up allowed 14 days to cancel ( which I believe it should do ) then what you have done should be sufficient.
You could leave it a week and then perhaps email their complaints dept for a reply.
I’m also assuming that their T and C doesn’t try and suggest that in the event of cancellation they are still entitled to something ?
Afaik each Finance company will be contacting each customer and even the FCA has said you don’t need to contact a claims entity.
How far back each company will go is of course another matter and indeed whether they all do as they are told is something else.

If it were me in your position, I would be going onto their website & emailing every email address you can find with a very strongly worded letter detailing your contact to date, your instructions, requests & be VERY clear on what you have not asked for, probably also title the email "complaint" or similar.

I used your website to research car finance agreements. I did not intend to instruct you to act for me. I have subsequently attempted to contact you by telephone to cancel without success. All I got was a robot advising me to cancel by email. I have also sent you numerous emails asking to cancel the ‘instruction’ without response.

I now require you to cancel my claim (though I deny instructing you) and remove all of my details from your database. You are not authorised to hold my information.

Please find enclosed a copy of the signed cancellation notice I sent you by email immediately on receipt of your instruction email.

Please confirm that you have complied with my requests.
