Help please: speeding and failure to provide details
Discussion
Hi everyone,
I'm hoping I can get some help/guidance on what to do and what to expect.
I have just received a single justice procedure notice; simply I forgot to update the address on my V5c when I moved house a few years ago.
I did it when I remembered earlier this year (after getting a parking fine in Lidl who caught up with me much faster!)
The notice is for a speeding offence in September last year, and a subsequent failure to provide when all the correspondence went to my old address. Annoyingly I did change my driving license but forgot to do V5c.
I am guilty of speeding for sure, and I suppose I'm guilty of failing to provide (as well as also not updating my V5c too!) but I'm not sure what to do next, and whether I can have a defence for not providing because I'm an idiot who didn't do the paperwork!
Also I'm expecting 3 points for speeding, what's the deal with failure to provide?

I've received the documentation asking to plead guilty or not guilty to both speeding and failure to provide details.
You definitely need someone who knows stuff to advise, but here's an almost certainly erroneous line of thought....Can you be guilty of failing to provide if you weren't asked to? Yes you are guilty of the speeding and of not updating your V5, but you didn't get the S172 request.

Speeding. Guilty
Fail to give info. Not Guilty
Ignore nonsense from the Foolish Legal Advice forum about attending court and speaking to the usher.

Thank you, I appreciate the advice. Will it be as simple as this, or is it worthwhile employing you for a defense/further advice? Speeding. Guilty

Assuming a low excess speed then it’s too simple a case to take on but I could help with the wording of the plea responses and assist you to contact the prosecutor. No charge for this. Email is best method to contact me.agtlaw said:
