M58 yesterday. Had the 50mpg advisory sign up. Orange flashing at side of road, not in a red circle.

I was doing 60 along the entire road.

Saw a police car with lights on on hard shoulder.

It was clear, little traffic

I was doing 60. Tbh didn t even think to slow further, but I do change to middle lane.

Saw the officer at the back of his car raise up a speed gun, then saw a car had come off on to the embankment.

Not sure if he was gunning before I saw him get back into position.

I guess I could get done for due care and attention.

I m hoping he was looking for people doing 70+ in a 50mph advisory.

The road was clear, no traffic build up, no brake lights ahead. I was already doing 60 on a stretch that is NSL.

What makes you think "without due care" would be the alleged charge if you were doing 60 in a temporary 50?

I understand that an advisory speed, with orange flashing, isnt legally enforceable for speeding. It has to be in a red circle.

But they can issue a without due care or attention. Most info suggests that’s if you have an accident and are going above the advisory speed.

Not a lot of people know the difference between an advisory with flashing orange and a mandatory with the red circle.

Yesterday it was most likely for lorries due to high winds.

Forget about it.

You were doing 60mph in a 70mph limit. Unless there was extreme weather or you were driving a high sided vehicle there’s no due care to consider.

FYI if you use the lane keeping assist adaptive cruise control it takes away most of any wind gusts when it’s a bit blowy.

The advisory speed sign are not legally enforceable, so I guess you are ok.

A note if the police had pulled you over they would tried to trap with an opening question like "do you know why I pulled you over?". Should you said something like "I was not aware of my speed" or "Sorry I did not see the sign" then you are opening yourself up to driving without due care otherwise all good. The best answer that I can think of is "I was expecting you to tell me your reason?".
