Funnily enough I had seen it for sale locally in recent times.

Taking the badges of a fake Ferrari doesn't stop it being a fake Ferrari.

Yes I have. Doesn't make what I said incorrect ie A fake Ferrari with badges removed is still a fake Ferrari.

It's an interesting one. As you say, the price dictated it wasn't the real deal and anyone in the market can plainly see that from 50 paces as usual.

Looks like its a copyright issue which seems a bit draconian. I mean, I understand why the Italian authorities get sniffy on clones of their own products, but the Spanish police to do so seems a bit harsh.

Yes a civil offence surely, not a Police matter.

Depends what country you're in.

Some countries only protect the "name and badge" while others protect the "shape", a bit like copyright in a book or artwork.

Hmm. Although Ferrari may not have any legal redress in some jurisdictions, I would say it's still a fake Ferrari, if it is built to look like, and does look like, a Ferrari.

There is a funny area of Spanish law whereby you can issue a denuncia for what in the UK would be a civil offence and it then comes on the radar as a criminal offence in Spain. What I find odd here, however, is who would be pursuing anything of that nature as surely its no one at Maranello.

Either way, interesting outcome so far.

Agreed. Thats the point of the kit/body conversions in the first place.

Wether they can protect their design in a particular country is a different matter.

Here is the article:

Man arrested for selling a fake Ferrari built on another vehicle

National Police in Murcia detect a car that imitated a Ferrari 360 Spider with counterfeit logos and design

Murcia - The National Police have arrested a man in Elche for an alleged crime against industrial property after he put a vehicle up for sale that imitated a Ferrari. The investigation began after an online advertisement was found for a car resembling the 360 Spider model at a price far below the usual rate.

The agents, from the Cybercrime group of the Murcia Police Headquarters, verified that it was a replica built on the chassis of another brand, using fiberglass and low-cost materials, but illegally reproducing the design lines, logos and typography of the Italian firm.

The operation led to the vehicle being located in the El Altet area, where it was impounded. Despite having documentation compliant with traffic regulations, investigators concluded that the use of Ferrari identifying elements constituted a criminal offense.

The detainee is accused of infringing the brand's industrial property rights, in an action that highlights the police's increased vigilance against this type of fraud in the used car market.

I sold a Harley Davidson fabric iron-on patch online about 10 years ago, it was a cheapo one I didn’t know the origin of but sold it for a few pounds while having a clear out. I kid you not, Harley Davidson contacted me and threatened legal action!! Unbelievable really, over a patch. It must’ve cost them more money paying someone to write the letter than I’d have made if I sold 100 of the things.
