A friend (honestly) got caught at 50mph in a 30 zone on his bike. He's responded to the initial letter saying it was him driving, and not argued. He has now received a letter saying that the matter can't be handled by the camera ticket office - it will be referred to the Magistrate's court and he will receive a Single Justice Procedure notice.

Does anybody have any idea what the penalty might be and how best to handle? Thanks in advance.

He should probably be contacting AGT Law who is a member on here, he may well post a comment at some point but that's what i'd be doing.

50/30 mph is usually dealt with via the Single Justice Procedure rather than a Fixed Penalty.

There is a risk of disqualification but 50/30 mph is more likely to resolve with 6 penalty points.

There will also be a fine, surcharge and prosecution costs.

I don't know your friend's net weekly income, so it's difficult to say much about the fine.

Ignore nonsense posted online or AI bots - for example; "This is a Band B offence" - "the fine will be 100% of his weekly income."

The fine is limited to £1000 and the surcharge is 40% of the fine. Prosecution costs are usually around £120.

If he pleads guilty at the Single Justice stage then the most likely fine is two-thirds of his net weekly income, but because the limit is £1000 then it would not ordinarily exceed £666. The 40% surcharge is in addition to the fine. Prosecution costs are additional to the fine and surcharge.

I don't know if your friend has any relevant penalty points.

If his preferred outcome is penalty points then an online plea - guilty I do not want to attend court - is probably the best option.

He should include offence mitigation and personal mitigation in his response. Again, ignore foolish forum nonsense about how only offence mitigation is relevant. The offence guideline literally says otherwise and personal mitigation is most definitely taken into account.

Overall, a very high chance of 6 points. Possibly 5 but 6 points are more likely.

I was issued one of these. Bang to rights, no point in pleading not guilty or claiming mitigation of some kind. Also 150 miles from home so really didn’t want to ‘have my day in court’.

Result was £70 ish fine + £30 ish victim surcharge and 3 points. Total was £100 so the outcome was exactly the same as a fixed penalty. I think even the magistrate thought it was a waste of everyone’s time
