Had a letter from DVLA stating that I had not put my Merc on a Sorn and telling me that I was to be fined £40. Sent them back a letter with a photocopy of the Sorn and post office receipt.
I have now had another letter asking me to fill in a sorn that they have sent with this letter. (Before you read this the car was put on sorn in August)

-----------------------------------------------------

Dear Mr ************

Thank you for your recent letter concerning the late licensing penalty requested from you for allegedly failing to relicence your vehicle as required.

The contents have been noted (meaning that their computer system is not working properly)and under the circumstances, no further action will be taken on this case. (Great your system is not working, so now your being kind)
However can you please complete and return the enclosed Sorn Declaration as the original application was not received. (Funny that I sent you a photocopy of the original that I gave in at the Post Office)

Please note that a SORN Declaration cannot be back dated.

Mrs **************
Enforcement Manager

Had the same problem with one of my other cars, the way I read this is that if I fill in the SORN back to August she is going to fine me anyway for backdating it!

Even though it was put on a SORN in a Post Office at the proper TIME.

So what do I do now?

I would send recorded delivery, a strong letter for the personal attention of the Managing Director at DVLC, and point out, politely, and very strongly what a bunch of plonkers they are, and that you have correctly completed, and posted the SORN declaration, and intend to take no further action.

Insist that you are sent a response to said letter.

Yes, I think i agree. I SORNED my Ford Granny in the spring and I'm just thinking of getting it MOT'd and re taxed for the winter 6 months from November 1st.

I'm afraid that if I'd received a letter like that and sent back a photocopy of the SORN. ....My reaction would be...Take me to court then if you think I'm guilty!...you incompetant...........

8pack,

If you want a couple of NEW spares for a Ford Granada let me know, (find address on my profile), for sure got 2 rear brake drums, (my granny was a Ghia 1994), plus some other bits and pieces. Currently offshore so dont know exactly what I have, I will gladly send them FREE OF CHARGE to any UK address.

Background was I took car in for MOT, they got the parts, I changed my mind, sold the car for a Volvo, hense I kept the new parts.

Lovely car as well, the 2.9 V6.

That's very kind of you Vipers mate, mine is a 1989 2.0i ltr t/c Ghia "S".

I have to say that: "at the moment" it's still.....perfect!.....almost 100,000 now! And NO problems!...

Not the fastest I grant you, but very reliable. I've covered many miles across Europe and back in it, and still would!given the chance........ It's garaged all the time, used Mobil 1 since I had it.

I took the decision this year to tax it for the 6 winter months only and retire the "Cat" for the winter, oh! if we were taxed for the period of use only? say by fuel tax?...

I had some slight damage (replaced now)from a woman who decided to turn left from the inside of a traffic island and RAM my rear off side door one day but other than that........

Nice to meet another "Granny" lover!.........

Nice one, mine was a Granada Ghia 2.9 V6 ex fleet car, got it when it was just 4 years old with about 115,000 on the clock FSH, thought to myself, "Well it may be an ex fleet car, but you dont give them to boy racers", lovely motor, set the criteria for my next one.

My first auto, wouldnt change now for the world, cruise control, and AC, what a joy to drive. Sadly keeping it on the road was becomming expensive year after year, why I dont know.

Sold it on in 2004 with then nearly 174,000 on the clock, checking the RAC web site yesterday, it changed hands again in August this year, so hopefully it's still getting some TLC. Mine was the 5 door by the way, great for shopping, and light removals, like taking sons stuff to Carlisle for his stint at college.

The phrase which springs to mind is "They dont make them like they used to", oh well life moves on, when I got my next car, my criteria was:-

a) Auto
b) Cruise control
c) AC

Just hope its gone to a good home, sniff sniff.

Slight thread hijack, sorry.

Like you for some time I have been in the habit of photocopying papers sent to various Govt departments where loss of or non receipt of such papers might mean a subsequent bite in the posterior. Also keeping receipts relating to Special delivery or method of transmission etc.

For some time rather than a photocopy I have been keeping a scan stored on the PC which is backed up regularly.

What is the opinion of the powers that be on here regarding admissability of scanned documents or printouts thereof. Any easy way to prove contents haven't been digitally fiddled with?

Not much Fif for a copy proves very little. Foolproof - Sworn evidence of that you posted the document backed up with certificate of posting. Very similat to NOIP.

In the SORN scenario where posted and no record at DVLA I would be tempted to draw DVLA's attention to Section 7 Interpretation Act 1978:

--- where an Act requires any document to be served by post (whether the expression "serve", "give" "send" is used) then unless the conrary intention appears, the service is deemed to be effected by properly addressing, pre-paying and posting a letter containing the document and unless the contrary is proved, to have been effected at the time at which the letter would be delivered in the ordinary course of the post.---

goose, gander, sauce spring to mind?

Interesting that they won't let you backdate the SORN.

THEY want YOU to fill another form in. But what date do you put on? If you put the current date down, then there's a big gap between the date you took the car off the road, and the date that you applied for the SORN on the second form.

So what happens then? Do they then chase you for unpaid tax?

I'd put the date that you put on the original form. Either that or don't fill in anew form, send a copy of the copy of the original.

Cheers DVD I'll bookmark that piece of advice.

So the copy itself whether paper or digital becomes not much more than corroboratory to the sworn statement and the posting receipt.

This my problem how can I fill out another SORN when if I do, I will have to backdate it as the car was put on SORN in August.
They seem to forget that I sent them a copy of the receipt that was entered into their poxy computer system.
If I do as they say I can be fined for backdating the SORN?

Is sending off a form that was filled in some time ago the same as backdating in the eys of the law?

Write on the form the fact that this is second notification to one dated.....(original) forwardec to DVLA.

Put this in a prominent space.

If it is legally any way related to the S172 notices then it might be perfectly ok to send a letter which includes all the information requested but expands on it to say that it *was* taken off the road on XX of XXXX and will not be used on the road until further notice.

I did read the legislation and recall the wording to be ambigous. It is pretty silly that you are legally obliged to jump through their hoops annually just for owning a hunk of metal which is on private property.
