I bought a new build house.

I have a thermostat in the master bedroom and a thermostat in the living room.

The master bedroom thermostat only controls the temperature in the master bedroom.

The rest of the rooms both on the first floor and ground floor are controlled by the living room thermostat that is on the ground floor.

Am I correct in thinking that heating zones have to be on separate floors? The definition of a heating zone in Part L reads as such

“Heating zone A conditioned area of a building
which is on a single floor and has the same
thermal characteristics and temperature control
requirements throughout”

The only potential issue is the house isn’t greater than 150m2 so doesn’t technically need more than one zone for heating.

Have I got a leg to stand on when this inevitably becomes a fight with the builder? I would like to be able to heat the upstairs at night and not have to heat the whole house for obvious reasons and I imagine getting them to redo the plumbing and also make good is going to be both costly for them and massively inconvenient for my family.

Your radiators will have TRVs. Use them to zone each room.

That’s not the point though. The layout of the heating doesn’t make sense and I want to know if it’s correct.

dont forget, a "new" house could be built to an approval a few years old,
it was tightened up a couple of years back, as 10-20 yr old approvals were being built,

As above set the trv or buy smart ones.

If you say the regs done cover houses less than 150sqm and yours is less than that you have answered your own question.

The regs don’t cover your house. It only needed a minimum of one zone which you have.
It won’t become a battle with the builder. There’s nothing to fight about. The system works as per the design. You bought the house. Live with it. Enjoy your house.

I've a new build in Scotland, but built to regs pre 2025 when I bought.
I've got two zones - upstairs and down. However each zone has one radiator on different floor for some reason.
Room stats are definitely the way to go.
