55mph in a 30 - what next?
Discussion
Hello,
I know it sounds bad, but this was on the A487 in Newgale (Pembrokeshire) in October (no tourists). Big wide coast road, no pedestrians, not built up at all, fine visibility, a few sheep maybe. Can see why its a 30 zone in summer...
Have had the NIPS, think it was a mobile van that got me. Worryingly didn't spot it!?
So do I take it on the chin and send the NIPS back (I've got 3 points on my licence), or is it worth pursing the PACE letter argument I've read about? Can I expect a ban or 3+ points?
Thanks in advance for any advice,
James

I got caught doing 57 in a 30 and was awarded 3 points and the usual tax. Slowing coming out of a NSL, I didn't realise that the 30 sign is located on exactly the spot where 60mph changes from being perfectly ok to virtually suicidal. Still, having paid my debt to society I am now a totally reformed character (not).

Dammit how come you only got 3 points and I got 6! Im jealous! It would have meant the difference between keeping/losing license for me.
Because it was a ridiculous limit in a stupid place, the policeman knew it and I knew it.

On that note - is it possible to argue that with the local constabulary? I've heard of people receiving lesser fines for standing up in court and doing something similar.
Thanks for all the comments so far.

Make your mind up time. S172 not returned in signed format then they do you for failing to name. Signed you have your chance to speak in Court.

So long as you signed the PACE letter and provided all the information required by the NiP under S172, then you're OK as far as identifying the driver is concerned. Whether they still prosecute for speeding is another matter. They will probably send an FPN, but if you indicate you wish to plead 'not-guilty' and wait for a court date, they have to send all the evidence they wish to use at least 7 days before the hearing. If you 'tough-it-out' and keep on pressing the PACE/ECHR route it may well get dropped. That's happened before, but not always.

Police And Criminal Evidence act
European Convention on Human Rights
Fixed Penalty Notice
S172 - this is bit of the law they use to get you to confess to the crime. The form they send says "your car was speeding. Confess or shop someone else. The penalty for not confessing or shopping someone else is just as bad (most often) as the penalty for speeding." They charge you with a S172 offence (failing to name the driver) if you don't provide a name.
