Hi all,

I got caught by a mobile unit doing 39 in a 30. It says on the letter that there are certain rules they must comply with with regard visbility of the mobile unit, and knowing the road as well as I do I am sure they must be in breach of these conditions...

A friend of mine, also on PH said that there is a solicitor in England (he has forgotten his name) who is expert in handling these matters. Could someone either post up or email me through details of an expert solicitor asap!

Thanks in advance for any help!

Matt

ps. What can I expect for this, is it 3 points and a fine?

I think you may be refering to Mr Nicholas Freeman of Manchester for a fee of four figures I believe.

What mentioned should attract Conditional Offer which is £60 and 3 points.

Under the Act there is no defence that the speed detection device has to be overt.

Hi Matt.

Dwight is right. He has a phenomenal record of success. This is supported by the £750 to look at your case and £4000 per day to represent you. As you are not allocated a trial time until that morning you will need to pay for the full day. Due to the fact that he charges that rate, even if you win the magistrates will not justify your costs demand and it will still leave you approximately £1000 short.

It really depends how rich you are!

To be frank, from experience the positioning and use of speed cameras is under the ACPO guidelines. These are laughed at in court. As they are 'just guidelines'. As far as I am aware, the operator could be in a tree, sat on an elephant whilst wearing a clown hat, randomly waving at cars a kilometer away, as long as he gets a reading and says it is your car, you are stuffed. This line will unfortunately not prove your case.

A more financially viable way of fighting it, if you believe that you werent doing that speed would be to plead not guilty. Request the full tape of the vans activities.

THere is a chance due to the amount of publicity that there are errors on tapes, that they just wont bother and drop the case. Even if they do it may show some errors which will prove that the setup of the device was incorrect which will prove your conviction unsafe.

The above will cost you nothing, and will give you a much better chance.

Hope this helps! Let us know how you get on with getting the video!

Edited to add:

Looking at your car you wont be able to prove to the court that there arn't any flat surfaces to get a laser lock on that beast!!!

You're better off using the Pepipoo PACE letter and saving your money for appeal.

If there is a video, it can often work in your favour to insist on it as they really don't like releasing it. Can't think why

It's spin. there are no rules, shoved in a dustbin up an alleyway is good enough for a conviction.
