So, now we are ready to tie up the lease on my new unit, the Fking landlord wants to add a clause saying he can give me one months notice before kicking us out. I'm left with no time to find alternative premises, meaning unless he reconsiders.. I'm leaveing my self open to being royally fking shafted!

Do you have to move? If not, tell them to stick it - I'm not sure about industrial units, but office space is plentiful at the moment, buyers (leasers) market and all that ...

I have three weeks to be out of my present premises..

Premises for us, because of what we do.. are nigh on impossible to find in Surrey.

The rent is agreed, no problems there..

Seems he's concerned that any noise issues will risk him getting planning permission for some residential houseing he wants to put up in a couple of years..

but a brownfield site? In surrey? Have trouble getting planning permission.. HELLO!!!

He bought it to develop it, and I've know all along that in a about a year and a half we will be kicked out, this is a reasonably short term thing after all.

If he does'nt budge tommorow, i'm going to call his bluff.. and sweat it out for a couple of days

Is he asking to exclude the lease from the Landlord and Tenant Act? If he is that should be reflected in the price. One month break clause is very unusual for a commercial letting. If he isn't planning to exclude the lease properly and is just putting a break clause in then it's almost certainly invalid and you'll have protection under the Act.

Post some more info on the details.

Yup, if it's a fixed term, he can't just kick you out unless you breech something you are covenanted to do in which case he can seek forfeiture (as long as there is a forfeiture clause in the lease).

What's to stop you simply refusing to move out if he takes advantage of this clause?

The landlord won't budge, so i told him to stick it.

The agent however.. ' forgot' to mention the totally suitable ex MOD property in Chertsy, which i am off to look at later today

Well good luck with the MOD property...........I always say things happen for a reason, but am having trouble taking that advice myself just now.

Sometimes its hard to find the reason when things that happen cause much emotional pain.
