Depends on the situation, if he left the woman and they are his kids then maybe he ought to pay up . . . if she left him or they are not his kids then do whatever he can to escape.

Whilst I agree that is a huge amount of reported cases the CSA are a bunch of incompetant morons, I dearly hope they get my sisters case right. She and her ex-partner have had 3 kids together (which he wanted) but after she got post-natal depression (which he told her she was making up ) he threw her and the kids out of the house when she was 7 months pregnant with the 3rd kid (no denying it is his) and moved a girlfriend in. He also bullied her into signing over to him her share of the business they ran together. There is also other stuff which I won't go into. Awful, awful person.

I feel very helpless because if I do anything like set the VAT/Tax people on to him (I am pretty sure he is dodgy) he will take it out on her The Social security people seem to be useless too which is particularly grating as she has worked and paid tax since she left school until she had the first kid 5 yrs ago. Sponging doleys seem to get priority over someone who genuinely needs help All she wants to do is get back on her feet, get the kids to school and get back to supporting herself and the kids by herself. Surely this is what the CSA/social was set up for?

The CSA was set up to reduce the amount of benefits the state has to pay to single mothers. It has nothing to do with their welfare.

Without divulging to much into his private life they are after him for two children.

First child;
He was living together with someone and they had a child, after a year she went off with another bloke, the bloke she left him for had a nice big house etc and was set for a ready made family.
My freind tried to get access to his child but it was at first made hard (he didnt even know their address)and when he did make arrangements his ex wouldnt keep to times and would muck him about,it used to kill him.
In the end his ex and her new partner made a deal,"we are willing to for-go any payments for the child if you disappear into the back ground and leave us to get on with our lives".
This was a hard choice for my mate as he was getting mucked about anyway,he had the choice
a/Take their deal and let his child hopefuly enjoy a close family relationship with no complications and at the same time cut ties which in time would make things more emotionalt stable for him and every one else concerned ,primarily his child or
b/Persist with it and hope sense prevails and access is offered and guidelines are adhered too,(if the pas few months were to go by,NO chance).

In the end he decided to let go and the case went to court,This is where it gets complicated.
At that time the court in his town(Basingstoke) was closed for a refit,so it went to another towns court(Andover),the judge heard the case and his child was awarded the responsiblity of the new father, they even changed the childs name to the new fathers.

My mate walked away from court with all responsiblity removed from him ,both parental and financial.

The mother married her new man and they had a further child, twelve years later they got divorced and the bloke resisted demands to pay any maintenance for the child that was awarded his responsibility ,so the mother and CSA came looking for the biological father, who told them to get lost and informed them of the agreement, the CSA wanted proof of the agreement but since that court day the court in the other town(Andover) has closed and he can not find any proof of paperwork from that day.

Now the CSA are looking for back payments of the biological father.

Even if she left him, he should still pay up. Since they're his children, he is responsible for his share of their upkeep regardless of how and why the relationship came to an end.

I would agree with the proviso that the Mother permits proper access, and there are no special circumstances such as the one ZRCliff details above.

I have also heard this. If the man agrees to help bring up the children (ie for 5 years) he is classed as the father, regardless of biological or not.

Solicitor, MP, newspapers - also, there will almost certainly be a record of any adoption and name changes somewhere, won't there?

Yes the name change will be documented, but maybe not the reason why. But the solicitor may have a copy of the court hearing. It will depend on how long they keep documents after the fact before destroying them.

Get him to ring his local court, and ask where the documents from the court that dealt with his case where taken to for storage.

Sorry i should of said this first reared its head in 2001-2,he inquired ,looked but couldnt find any record of the case, after a while of looking with no results he has since moved about.
He has no record of the case number either although it would of been heard at the court around 1990-91.
It wasnt adoption as so much as a person being awarded joint parental responsibility.

I am told that the court in Andover closed in the 90's some when but dont know where the documents would of been sent or how to find them, all ive got to go on is "Name Versus Name".

Since it's conception, the CSA has lurched from crisis to crisis.
Put in place to provide and maintain children.
But all it seems to succeed is in gross ineptitude.
AND, all at the expense of the people it is suppose to protect:-

THE CHILDREN

Get him to ring the solicitor that dealt with it and explain what is happening now with the CSA. They may have some ideas of how to find paperwork for him.

Problem was he never used a solicitor as he just swallowed hard and became amiable to his ex's demands and just went through the motions for an easy life.
On the court day ,he walked in,agreed to what they said in front of a judge, then walked out thinking it was all water under the bridge.

If there is anyone out there that knows when and what year the Andover court closed and what they did with the records then i would be msot obliged to help him follow this up.

Pretty silly of the guy not to have gotton copies of all the paperwork at the time. Moral of today is to "cover yo' ass" legally AT ALL TIMES. sad really but sign of the times.

Anyhoo..that doesnt help at all now so bst of luck with the search.
