im waiting for the video evidence to come through to the solictor. They have ajourned it 3 times because they havn't sent nothing yet. I saw the video in May about a week after it happened, so i know its there. Is there any chance the case could get dropped if they keep messing around like this. I mean i've got to go court again on tuesday to be ajourned again. Last time i went court the solictor got it delayed 3 weeks to give them a chance to get the video through. Again nothing, so..... have i a chance of it getting dropped? I mean it happened may 2nd, its going on a bit now.

yes you have got a chance... tell them that being punished is one thing, but this is mental cruelty, and move that the case be dropped if they can't get it right after all this time. A nice letter to CPS may work wonders. I got a speeding dropped because of this sort of thing.

In view of the apparent lack of evidence - Not producing the video tape and asuming that you intend to plead not guilty to 'racing'

I would speak the soilcitor and discuss the posibility of insisting that the case goes ahead when next scheduled i.e "The defence are ready to proceede, and due to the continual adjournments of this case it is now costing my client a substantial amount of money, my fees, loss of earnings etc, for which we will wish to seek recompense"

Upshot of it is - Its up to the prosecution to prove ypour guilt the video may prove your guilt, but by failing to 'produce' it as evidence you may well have a strong case to plead No case to answer

I have just discussed this with a Part time magistrate who happens to be doing some work for me and he thinks you could get somewhere with it.

be a little cautious as you know this video DOES/DID exist at some point. If you push toohard and then it turns up, you wont win any friends.

I'd agree with Herts and take his approach. Just be polite at this stage wih a letter cos it may do the trick (though comparatively unlikely for racing vs speeding methinks)

Speak to your brief about Human Rights and undue delay. Scotland had this imposed a year before England and has built up such a head of steam that 40% of cases which refer to it do so saying the delay is a breach of human rights. The majority are succesful in getting the case thrown out.

no offence m8 but this is a sign of how good you mouth piece is.

a good one would be making a real fuss about it now and puhsing for it to be droped.

went court, solictor was going to ask about it being dropped. He got a call on his mobile and the video TURNED UP . So its been ajourned until 7th January. What a depressing christmas. Well its the end of the road for me, im royally screwed. Solictor appealed and got me granted legal aid, so if i go not guilty its All paid for.

Well, if it makes you feel any better, I'm in court on the Jan 8th in Dumfries! I shall most likely get banned again. Wouldn't mind so much except its a 5 1/2 hour train journey

These things happen, best not to let it get you down. I have a driving ban starting early January but to be honest I dont really care that much. Its 1 month and I see it as a good way to keep fit!

id like to know, is racing on a highway ALWAYS an instant 12 month ban?. Ive been driving less than 2 years so will that change the sentence a bit. Like they take my liscense off me and a 3month ban instead of a 12month?

sp60, Deester and zeroprobe you have my deepest sympathies. Try to keep your chin up. My advice:

Save up your money and your frustration and when your back on the road let rip with the biggest, smelliest, most polluting and preferably British V8 you can get your hands on.

hey froth, that's not a bad idea and a very nice sentiment, thanks!
Personally I don't have a problem with my conviction/s (if you see what I mean!). I think the police are correct. In both instances I was speeding excessively for which I knew the consequences. I will add at this point tho. that in both times it was on an empty motorway/dual carriageway and I certainly don't condone all speeding.
The thing that bugs me is that if you have enough money, you can generally get away with it, or at least get off more lightly. But that's life I guess!

As for the length of zeroprobes ban... well I just don't know. I can't honestly see that they will ban you for 12 months (unless you have other convictions), but they have brought in new laws relating to new drivers and I believe a probation period ? so I guess you'll just have to wait and see. I suggest grovelling lots! Best of luck anyway.

Reading all this does make me wonder why we do it. My co. car (a 406 coupe 2.2) is one its way back after a job change. I have naturally ensured that she is well run in for her next owner. Now I'm filling my troosers expecting an envelope through the door anyday.

Can the dibble speed gun you if you are going opposite directions in the fast lane and one of you is doing well lets say a little more than the limit..

I bought a copy of the drivers survival handbook. It has got me off a ticket once.

I also had another at 97 in my M3 (before laser jammer) and had to grovel and throw myself at the mercy of the magistrates court nazis and plead exceesive hardship. I am self employed and employ others no licence=no business+4 redundant blokes. Thankfully they believed me and gave a £450 fine and allowed points to go to 14.
