Another friend problem, They got a NiP for speeding on M6 south in Cumbria, It was returned stating partner was driving(female). New NiP arrived for her, she filled it out and sent license and cheque in return post. Later that day, she thought that she might have put wrong date on the cheque, eg 12/03/06 instead of 12/02/06. When she phoned to find out, she was told "don't worry, we will changed the date". I though that was illegal, it even states on NiP that post dated cheques are not accepted.

A week later(today),a new NiP arrived for male partner saying "you obiously haven't seen the photo evidence. It doesn't look like a female driving. Do you want to rethink? Her license or cheque was not returned.

The photo is NOT that clear but the cross hairs are:
1st photo the cross hairs are on number plate
2nd photo, they are on windscreen
3rd photo, they are on the grill below the bonnet.
Also, the motorway is empty apart from one other car

They admit they were above 70 when they saw the van, but NiP is for 91 and they say no way.
Is it possible to contest on account of cross hairs not in same place

If she's 'fessed up' and sent the cheque/licence, there is now probably no way of contesting it.
It looks as though they have checked the photo and suspect that the person 'fessing up' ain't the driver. Be careful as if you do try to cause a problem for them they may stick you and the lady on for 'attempting to pervert the course of justice' which carries a possile spell in the nick. A guy was imprisoned for doing this not long ago.
Cumbria Camera Pratnership are very spiteful people. Carful here!

I agree. Though there *may* be some kind of evidence to hang onto if you request the video and plead not guilty, it is unlikely. I contested a similar charge where i was zapped at 92. My 3 points and £60 turned into 6 points and £300 for having the audacity to not accept I was doing something I was not...

Also, your friend may look a little silly in court when the video evidence is shown that in fact he is driving... And a large book may be thrown at him.

I would snap the guys hand off and be thankful it was only £60...

It wasn't that they were trying to wriggle out of it, he is ready to accept it, but more so that they accepted her license and cheque, but now have changed there minds but not sent her documents back. They will have to sit on it untill her licence comes back to see if any points have been added. Surely then they can't charge him with the same offence

Surely, Shirley, what they have to do now is to write back saying that we could not remember who was driving and answered in good faith in the genuine belief that bla bla bla. But if you Speedfinder General has evidence that we were mistaken please provide it and we will reply accordingly.

Then surely Speedfinder general has to provide evidence of sufficient clarity and then they can do the calcs to see who and figure out any other possibilities.

Think Cooperman was right to say beware, Cumbria are vindictive spiteful and small minded.

With Cumbria you should also request the service mu,ber of the PC who formed the prior opinion of speed before the speed measurement device was used. I believe Cumbria are still using mainly civvy staff.........

Human memory is not always reliable.

Surely the camera businesses and the law understand and make allowances for that?

Be very careful what you post on here by way of explanations. The 'Speedfinder-General', Callaghan, of the Cumbria Silly Camera Pratnership does read this forum, even though he is no longer allowed to post on here (he was 'Destroyer').
Apparently someone posted on another site that his girlfriend had taken the points for him in a Cumbria CSCP speeding case and the Speedfinder-General had it investigated with the result that two people were charged with 'Attempting to Pervert the Course of Justice' - very serious matter. It's almost as if the Cumbria Scameras can apply justice along with the 'spin' and obfuscation which emanates from that organisation.
My advice would be to ask for the evidence in order that you can make a judgement as you have, so far, acted in good faith to the best of your beliefs, but, of course, you did share the driving on that trip and you didn't keep a log of who was driving where and the law doesn't require you to. That should put it into a good context.
The Cumbria lot are some of the most self-opinionated and generally 'silly' scamera pratnerships in the country with scameras tripping at 79 mph on the M6.

In this case it is my freinds and not me that's involved. They did share the driving and also went past 3 scamara vans. After seeing the photo, although not too clear, it is obvious to them who is driving at the time. They first thought it was her but not now. He is putting his hands up but not while the theives still have her license and cheque(frauduently altered I might add)
