Driving a car to the post office to tax and pulled..
Discussion
Well not me, but a friend got pulled today driving to the post office to tax his car which he bought last week. He only just got it MOT'd and with the insurance to hand and the rest of the logbook (previous owner has done his bit) he gets caught on an ANPR camera, officer pulls him and fines him £50. He had all documents with him but they still asked him to produce within 7 days aswell..?
Is this right? he's pretty pissed to say the least..

Re - check with your friend for the true story Mickey. Too many ifs and buts that do not ring true on this one.
By sounds of it only offence for Plod to take action on is fail to display Excise Licence.(Ignore fail to notify change of ownership?)
Any proceedings for using without Excise Licence has to be authorised by DVLA who by the time they consider matters will have a current Licence showing in the file if said friend renewed there and then at PO.
If he had DL, Test Cert/ Insurance and produced to Plod why are they having him produce or has something else beed added?
If not in possession of DL and asked to produce may be a FPN for an endoresable offence which Excise is not??????

He has been in possesion of the car for a week, DVLA have been informed of a change of keeper and the police apparently confirmed this while he was there.
Like me he has a photocard license and i know he keeps it on him in his wallet, unless they want to see his paper counterpart?
I can understand if they are doing it for 'failure to display' but just seems a bit harsh, surely he could have been given time to tax the car then produce evidence in 7 days that he has done that?
Will have another chat to him about it, he did say he has 7 days to produce but 28 days to pay the fine.

Production of licence is photocard & paper counterpart together.
The only time you can drive a car legally without a tax disc, is to and from a pre-booked MOT test. I have an MOT booked tomorrow, so I've been checking up. Driving to get your tax disc is not a valid reason (unless it's on the way from the MOT testing station) so he deserves to get pulled. Sorry.

So what happens when you buy a car from a dealer on Saturday afternoon, go straight to the post office to get the tax, and find it closed?
That's happened to me twice.
He'd had the car a week and notified DVLA ...... who knew - in one week - that he had it ...... yeah, right. Unless DVLA have suddenly improved their act I would imagine if this was picked up by ANPR it showed as no tax and no current keeper.
As to getting a ticket - he may have been genuinely unlucky if he was truly on his way to get it taxed - not that there is an exemption. But, how many times do you think a policeman can get told "I'm just on my way to tax it, I bought it a week ago ......"
Having docs with you will not get you out of the ticket if the officer doesn't believe you. At the end of the day the only thing the officer does know for definite is that the car has no tax and is being driven on a road.

You're stuffed. You can't legally drive it on the road.

What he said. You should either arrange for the dealer to tax it, or sort the paperwork out before picking the car up.

You did`nt say whether the car had been on a SORN, the way i see thing is if the tax ended last month and you go to tax it on the 16th of the following month, you are back taxing it so to play fair you should`nt get done, but if its missed a month and you tax it on the 16th, missing out the month inbetween then someone did`nt fill in the SORN.
Perhaps it was showing up on the computer for the SORN offence and to save the hassle of proving the SORN offence they just booked him for no tax.

You used to also be allowed to drive an untaxed car to a polling station. I expect you still can.

Maybe you can point us to the legislation that allows this!
I have never heard it as an exemption but I would be interested to see from which Act this is allowed or whether it is another "mate in a pub told me" piece of legislation.

I'm sorry, but it really isn't worth my time to try and find it - it could take hours! Perhaps someone else knows? I'd be interested to hear...
