for the second time, I have received a speeding fine for a car I sold to a dealer in part ex 12 months ago.

stupidly I didnt sign the V5, trusted the dealer to sort it out.

I keep sending them back as not the owner, and include the photocopy of the receipt, but how do I stop them coming?
how come the police didnt get the first sale confirmation and mark the car on there files as "not registered, nick me" how does the DVLA and police link these details?

Write to the DVLA (or fax) stating when and where you sold the car and to whom.. sign and date the letter, and that should be the end of it.. had a similar thing with the Beetle.

have a legal responsibility to complete or sign the appropriate parts of the

No they use the one the DVLA give them as far as I know. However, unless you have actually sent a letter to DVLA as described (not just sent the NIP back saying this) it won't happen. Also, it has been known for DVLA to drag their heels when updating the database.

had the letter back from DVLA, they have noted my request, but without the new owner sending back the completed V5, its still technically mine, and I will continue to recieve any prosecutions...

I think Im going to declare it stolen, that will stop the bugger....
hopefully I might get it back to sell twice??

So what happens when you send back your part of the V5 and the new owner doesn't? What happens if youe part of the V5 was sent back, but got lost in the post?

There must be some way the DVLA can update their system in the event that something goes wrong.

Thinking about it (no V5 to hand), if you part ex a car, aren't you supposed to hand over the entire V5 so that another owner doesn't go on the record until its sold on by the dealer?

This does not sound right, as the car has been sold to a garage and you have the receipt, you are definitely not the owner, I suggest you telephone to DVLA and ask for a senior manager to sort this out.

Whatever you do, do not do this, you may end up being prosecuted for wasting police time, attempted fraud etc.

I foolishly let the garage sort out the V5, and signed nothing, just handed it over. so DVLA have no record from anybody; just the original ownership request wehn I first BOUGHT the car.

Well you should always send something to DVLA. If you have the old style document then you fill in the tear of bit and send it to DVLA. If you have the new style document you should have filled in the RED section "Notificaton of sale to a motor trader", got the dealer to sign it, and sent that bit to DVLA.
