One of the cars I own has recently been caught on a mobile camera van site whilst the user was on holiday, because the car is in my name [company vehicle but I`m a sole trader] the summons has come to me. I have written back an gained photographic evidence, which shows the rear of the car, the TWO people using the car with my premission, were caught in Wales on a piece of un-identifiable road [we live in London] and have therefore admitted that car was at scene, but cannot honestly indentify driver at that time, anyone know where I stand ?

I doon't think you have much choice other than to inform on the two people who were likely to have had the car. Put both their names down on the 172 notice and let them decide who was driving. If you have material information about who may have been driving you must pass it or face the consequences personally of not naming the driver.

I've just done this in a very similar incident. I could not remember who was driving the car at the time of the offence as there were a number of trips made down the particular road, and there were 3 of us driving on that night.

I gave all details of the drivers, and sent them back - but they sent me a summons for still failing to provide details, and also for the offence itself.

I've recently sent back to the courts my correspondance with the camera office, and my summons return pleading not-guilty as I did provide details, and I wasn't the driver at the time.

Interesting to see what happens next...
