Spoke to a mate today and hes been charged with dangerous driving. He was on the motorway and he noticed a car tailgaiting him so he brake tested them and they almost hit the back of him. Unmarked bib in another lane got it all on video so it looks like bye bye licence.

seems a bit harsh if the other car was close up behind him - surely thats dangerous driving in itself? how did the police prove that he deliberately brake tested the car behind him?

Very dangerous and stupid thing to do, could cause a massive accident. If somebody is tailgating you either ignore them or slow down and let them pass.

Disagree, brake testing is a greater sin than tailgating, anybody doing it deserves a ban.
It's just plain stupid.

Tailgating pales into total utter insignificance compared to the gross stupidity of brake testing someone for it. I dont often get tailgated, but I couldnt possibly imagine being dumb enough to tap the brakes out of pure spite and put the lives of others in the vicinity not even involved at risk. Deserves everything he gets.

I can well believe that 'brake testers' are stupid though, one of the last times it happened to me, a biker refused to move over from lane 3 to allow me to pass, despite lanes 1 and 2 being empty and no other traffic on the road either. His reaction? to brake test me! a two and a half ton Bentley, and he was on a bike! I locked a wheel FFS, he must have had a death wish.

Sorry IMHO, I think he sould be done for dangerous driving. He could have caused a massive accident. It's safer to slow down, without using brakes. And moving over ASAP and let the offending vehicle pass. Atb Derek

Brake lights came on, slowed down very quickly, nothing going on in front of him

He might try the bunny / bird defence, but tbh I think he deserves what he gets if he deliberately made the situation dangerous.

Falls far below the standard required.

How often do you find unmarked BiB videoing just in case when someone does do something like that! Good for them.

Yes indeed. Makes you wonder whether they hadn't noticed something already, and were in fact videoing the tailgating and would have dispensed their own legitimate form of justice - if the brake test hadn't happened first. Oooops - maybe.

Glad the police were there to catch him, that's one less dangerous driver on the roads.

the IAM thing to do is to slow down and increase your braking distance from the vehicle in front to allow said numpty more reaction time, nuff said?

if he was in traffic and couldn't move over

then he might have a defence that he saw something that caused him to break

if not

he might have been lane hogging

so was he lane hogging??????

Excellent news. Sounds like that tt who jammed on his brakes mid turn because he'd decided I was driving too fast through the corner.

No sympathy. If someone's tailgating you (and assuming you're not lane hogging in which case stop doing it!), simply slow down gently to open a gap in front then speed up again. If they come back up behind you, let them by.

Aren't the roads dangerous enough already without deliberately trying to cause an accident. Duh?

Yes I think you might do that as a means of prompting the tailgater to drop back a bit, but to actually brake hard is, I would say, a very foolish thing to do.

The current wisdom seems to be that in a nose to tail shunt the following driver is at fault, and I think that makes sense. Even so, if the leading driver suddenly brakes hard for no good reason, I would think he should be judged to share some of the blame.

Best wishes all,
Dave.

My only complaint is that both should have been prosecuted.

Agreed. Brake testing is stupid, especially at motorway speeds...

I hope the tailgater also gets nicked for an offence.
