Ive given the Builder the boot - usless *anker
incompetant twat, the extension was supposed to be finished for Christmas
Thing is I have still got most of his tools: cement mixer, very nice cordless hammer drill, kango, skill saws etc to name a few at my place. ive phoned him and told him to come and collect the but he hasnt arrived
probably aware that Mrs m is waiting with a rolling pin. we are somewhat restricted for space as I am trying to finish the bathroom, kitchen and playroom all at the same time as decorating the bedroom, mind you the tools have come in useful oner the weekend
and a mate wants to borrow the mixer if it was to get stolen from the front garden can I be held responsible??? And what if he doesnt come and collect his tools, can I keep them?

Loads of gyproc insulation boards in the shed and half a pallet of cement, coils of electrical cable (one is now only half a coil) bags of plaster, boxes of nails and screws and what i am told by a mate is a laser level.
Inform him that you are no longer prepared to store his materials and that if he doesn't turn up and collect them you will be leaving said items out on the front lawn/in street for him to collect at his leisure.
Obviously what happens to them at that point is purely up to your mate who wants the mixer etc...

In a similar situation (except the tool in question was a sodding great aerator) my solicitor sent a letter saying that unless the item was collected costs would be sought relating to the outstanding work and storage of the tools. I never heard anything back from the contractor, so once the costs had reached a similar value to that of the aerator we issued another letter saying we were going to keep it, or dispose of it in lieu of costs. It is in my barn as now, four years later. I think a similar letter might be a good idea on this one, as I would suspect that the builder could claim he expected you to leave his tools undisturbed for a reasonable period.

Good idea: gonna fax him now and give him seven days to collect them, if not i will deposit them in the skip that has been sitting on my drive for the last two months
