Notice cancelled ? Help please
Discussion
Hello,
My wife got fixed camera’d a little while ago, same road as last time, see post around 18 months ago lol, road is duel carriage way was a 40 now a 30, both notices have show 40 mph speed, well consistent at least
, she now has a road angel .
Car is registered to me, so initial offer comes through I fill in her details forgot to sign, sent off.
Then get letter to her for driver’s details, she fills in signs sent off.
Next a letter saying she had not responded to the offer of fixed penalty and she has 14 days or court, now the letter seemed to suggest there had been another piece of correspondence we had not received.
So I sent off her stuff licence and cheque as requested with a note saying sorry for any delay did not receive any correspondence since her letter for details.
Then a letter from Her Majesty's court service, Manchester’s Magistrates court with this wording arrived
"Conditional offer of fixed penalty-notice cancelled
I return your payment forwarded in respect of fixed penalty notice Cxxxxxxx as I am informed by greater Manchester police that the notice is cancelled."
Does this mean that no further action will be taken?
Thank you for any assistance.

Sounds to me that it looks like it's going to court..
They've returned your payment for the FPO and I would expect a Court Summons in a week or two.
I hope the fact you forgot to sign your initial NIP is not the reason why the FPO was cancelled.. Sounds a little harsh to me.
Maybe they think you've entered incorrect infomation in an attempt to avoid getting points yourself.
I hope I'm wrong.. Let us know if the whole thing get's dropped.
That would make a nice change..

I agree with Loose.
Sounds like the conditional offer has been withdrawn, not the charge.
When you go to Court, fill out the means testing form (to see how big the fine will be). If you plead guilty the fine will not increase (other than costs IRO £30-£40).
Once you have pleaded guilty you will be given the oppurtunity to speak. Provide copy of your letter and explain that there was no "conditional offer" received and you may get away with just paying the Fixed Penalty amount and costs. Unlikely though. All the Scamera Partnership will have to do is demonstrate that they have a letter on file, most magistrates on this type of case will accept that as proof that you received it.
You should also receive a copy of all this info and pictures etc from the Court prior to going. If there isn't the letter offering you the £60/3 points. Point it out to the scamera partnership before the Court date and you may be OK.

This could be read two ways.
Either the CO has been withdrawn and Court to be involved, or
Clanger committed by SCP/GMP regarding the offence and they had binned in total.
I would be tempted to write back to ask them to clarify the position either Court case now pending or NFA.
If the former I should point out that through clerical errors not all of your own making them you have been denied the opportunity of settling the matter under the CO procedure for which you would be happy to respond and pay thus saving time and money all round.
If they agree then you will save anything between 35 - 60 quid in Court costs that they will award on top of the fine. So result to you.
If they reply that the whole matter has been dropped then result to you.

absolutly the way to go. If it does go to court, there are plenty of news reports of postmen not posting letters or I bet the PO will have details of the annual missing post estimate whcih would aid what you say.
