Isn't it the Rover-marque sold, but BMW ain't saying?

BMW have sold the Rover marque, Ford have 90 days to take up the first option, following which it will go to one of the Chinese firms. I like the way Ford have said they expect any buyer to observe restrictions on the use of the Rover name on 4x4 type vehicles. Can they do that if they're not buying it?
