Hi All,
Can anybody please answer my questions for me?

I got pulled over by the plod M6 05:50 Sunday morning nice and bright condition empty motorway @ 102mph.(28/05/06)
I was give my NIP at the scene took my reliant docs into my local police station the next day and heard nothing since.
How long do the police have to contact me or can they just leave me dangling so to speak, also what sort of fine/ban should I expect (I have a clean licence)?
Age - 39
Car - Clio 172

Thanks for any replies,
Billy

They have up to 6 months in which to start proceedings.

So If I don't here from them by 28/11/06 I'm clear, if this is right I'm just half way there today.

They can and often do leave you dangling for up to 6 months I am afraid.

For over the magic ton a short ban is usually the outcome unless you are particularly good at grovelling and you get 6 points and maybe a couple of hundred quid fine.

I am guessing that you have either overlooked or discounted the possibility of pleading not guilty at this stage? It is possible but for something like this to win the CPS will have to make a bad mistake, and you may risk a hefty solicitors bill should you lose.

With a clean licence if you appear in court, plead guilty, remind the court of your clean licence and this was a one off you have learnt from then my money would be on the 6 point outcome.

^^^^^Sound good to me, looks like I'll have to practice my sad looking expression and maybe a few watery eyes.

This is the information I was given...

"They have 6 months from the date of the alleged speeding offence to 'lay an information' (application for summons) with the court"

this basically means that you could hear from the court more than 6 months after the date you were caught speeding.

I guess its down to individual circumstances but given the choice are you better looking for a short ban than driving for the next few years on six points?

So if I don't hear from them within or up to 6 months I'm clear, or could it be a little longer than 6 months?

It's just that I want to know when to stop standing behind the door in the morning waiting for the post man.

I know that feeling! Unfortunately you may not be clear after 6 months, they only have to start the court proceedings against you within six months from the date of offence, it is then upto the court to summons you with a date and time etc, so if they are going to prosecute then this is going to be the next thing you receive which could well be after the six months....

good luck, i hope it never arrives!

The date that counts for totting-up purposes is the date of the offence, not the date that the points were put on your licence...

Im in a similiar situation

I have a feeling i jumped a red light a week ago and ive been standing behind the door every morning.cant sleep, on the bottle feel ill you no what i mean. More information about what happened is in the topic that starts with help. Was it a traffic patrol or a panda car that pulled you?

Ive just invested in that book from EVO about the insider information the police dont want you to know. Written by an ex traffic cop with 22 years experience. Hopefully this may provide the answers for me. Ill tell you if i can find anything to help u when it comes.

Anyway so sorry to hear about this terrible persicution (spelt wrong) thats happening against you. You know what they say no rest for the wicked which now counts traffic fed on a sunday morning.
Hope it times out. GOOD LUCK

Endorsements must remain on a licence for 11 years from date of conviction if the offence is:

* drinking/drugs and driving (shown on the licence as DR10, DR20, DR30 and DR80)
* causing death by careless driving whilst under the influence of drink/drugs (shown on the licence as CD40, CD50 and CD60)
* causing death by careless driving, then failing to provide a specimen for analysis (shown on the licence as CD70)

Endorsements must remain on a licence for four years from date of conviction if the offence is:

* reckless/dangerous driving (shown on the licence as DD40, DD60 and DD80)
* offences resulting in disqualification
* disqualified from holding a full licence until a driving test has been passed

Endorsements must remain on a licence for four years from the date of offence in all other cases.
