Odd junction layout - Right of way?
Discussion
One for the BiB here, please.
The junction below is near where I live, and is the cause of quite a few near misses.
From the markings on the road, and the general layout, it is unclear who has right of way for certain manouvres.
The blue lines represent the edge of the road (or in the case of the one in the trees, a grassed reservation.
The only road markings are the ones you can see (i.e SINGLE dotted lines at the junctions near A and B)
The problems arise when a car travelling from A to B (bottom side of the blue reservation under the trees on this pic) reaches point B at the same time as a car travelling from C to B. They are both going to the road off the right side of the picture.
Who legally has right of way here, as generally neither of them want to yield to the other?
There are no No Entry, or One Way signs anywhere to be seen, and the bit under the trees is used by cars going in both directions.
Cheers guys.

I presume the car travelling from A - B is on the left hand side of the road as it reaches the road on the right.
The car travelling from C - B also on its left side of the road reaches the road on the right.
A - B must perform a right turn
C - B must perform a left turn
C - B has right of way because A -B has to cross over a lane.
If ive picked it up right there is no doubt that is the correct answer.

Without any road markings or road signs then that "junction" (if you can call it one) is un-controlled, in other words, the RTA 1988 does not make it an offence for any one person to do something wrong.
If there were a collision you would have to ignore who broke what give way rule etc as there are none, you would have to come down to each individuals actions and who was inconsiderate or careless as Sec 3 would be the only law you could go after someone for.
The highway code talks about giving way to traffic from you right and although the code is not law it could be used to support a charge under S.3
In all honesty I think unless there was a really stupid bit of driving then most officers and CPS agents would say "NFA"

As far as I can see from the picture, the road between A and B below the reservation is not part of the main carriageway and isn't separated from the wide tarmac area around B
That's right. It provides access for houses on the bottom of the picture. There are no lane markings on this stretch (its only just 2 cars wide).
The main carriageway above the thick blue line (reservation) is marked as normal with a central dotted line.
I am usually travelling from c to B, and from the comments, it looks like I need to buy a Landy Defender and just sod it !!

It looks to me as though you really ought to be going from A to B via C but are tempted by the shortcut A straight to B via the access road.
Probably the council ought to slap give way markings at either end of the access road but even if they don't it would be sensible to pretend they were there.
Can't imagine the folks living in the houses at the bottom of the pic are too happy about all and sundry cutting along the access road given that they have a specific reservation to separate them from the main road?
There is one near me where its pretty much a perfect four way crossroads, but the road markings for the main road take a 90 degree turn. Most of the traffic actually comes in or out of the two "side" roads, which are adjacent. This causes no end of fun, especially as most sat nav systems have the right of way going straight on.
Its the junction just outside Rugby, where the road go to A5, Clifton, Brownsover and Newton. The main road is the B5414 going from A5 to Clifton.
A stupid junction.
