overtaking on continous white line
Discussion
girlfriend has just had a pull from our Russian cozzers for overtaking an articulated lorry on a long straight road with a continous white line..excessive speed was not an issue
anyone know what the penalty is for this ..........Russian penalty, fine / ban ?
they have taken her license and issued a court date in a weeks time !
Offence under Article 12.15 of the Code Of Administrative Offences Of The Russian Federation ????
If so
3. Passing out to the part of the roadway intended for opposing traffic, when it is forbidden by the Traffic Regulations -
shall entail the imposition of an administrative fine in the amount of from three to five times the minimum wage or deprivation of the right to drive transport vehicles for a term of from two to four months.
If so
3. Passing out to the part of the roadway intended for opposing traffic, when it is forbidden by the Traffic Regulations -
shall entail the imposition of an administrative fine in the amount of from three to five times the minimum wage or deprivation of the right to drive transport vehicles for a term of from two to four months.

Isnt there something to do with hard labour in Siberia too!?
Seriously though, is that the only charge? It is worth checking.
Overtaking on a 'white line' is taken as a reasonably serious thing compared to speeding. Whilst I am sure that your girlfriend may be a competant driver, and without knowing the road, the continuous white line is there to indicate that overtaking is deemed dangerous on that section of road (this is where Vonhosen will reel off the Highway Code definition...
). Again, I am unsure of the danger in this scenario, but this would be compounded as it wasnt just a car being overtaken, it was an articulated lorry. This wont sound good in the officers statement, neither will it if there could be a 'near miss' implied.
She should have been told of the exact 'charges' she was being considered for, and I hope it was not too serious, and is only the single offence, as this is the type of thing which can be explained very differently from both sides of the police car windscreen.
Edited to add:
(This has really made my day....!
) Please discount pretty much a lot of what I have said! I have just read your profile! I assumed that you were in the UK and you were just making a comment on the harshness of the officers who pulled you over! For the benefit of other posters, you *are actually in* Russia.
I also take back about what I said about the 'hard labour', to make matters worse it also seems you are actually in Siberia....
Hope everything works out! And I am astonished that Von even knows about traffic policing all around the world... Let us know how it goes.

Looking at the tariff speeding has a sliding scale of punishments
From exceeding the limit between 10-20kph = a fine of half the minimum wage TO exceeding the limit by over 60kph = a fine of between three & five times the minimum wage & a ban of between two & four months.
If the actual offence charged is known I'll see if I can find it.
(The list I have is from 2002)

It is not unlawful to overtake where there is a continuous white line on your side of the centre line. It is only unlawful to cross that white line (except in certain limited cases) whilst doing so - Streaky
Which is the offence I've quoted, crossing the solid white line.

Thanks
I checked out with some ex Russian traffic plod and they said pretty much the same , although they did indicate that reasonably ..........300-500 ru ( 10 -20 pound fine )was a rough estimate for this offence paid on the spot usually paid to their back pocket
unfortunately for her the officer took her licence , so a visit to the local station and either larger fine or more worrying 2-4 month ban ,that could impact on her work
will keep you posted on the outcome .

Got pulled for the same offence in 2003 (but mine included speeding as well).
The statutory fines were mentioned...but in a friendly 'chatty' way...they were more interested in my bike and my travels than the offences. (Indeed I got the feeling that may even have been why I was pulled over in the first place!)
They did a full document check on me and the bike (Interestingly they appeared familiar with both the V5 and MOT) and wanted to see both the Russian insurance & RFL. Then I took 'photos of them on my bike and me on theirs. Then it was 'On yer way...ride safe'
Might well have been different for a local, though...or even a foreignor on/in a locally-registered vehicle.
Best, B
