Baxi engineer called fiddled about twice failed to rectify in the end sugested not using it!!
retailer says oh chimney 'wrong length'????? not our fault sorry WTF

OK, it was fitted by an aproved guy not their own they dont fir piffling fires only whole fireplaces apparently, it was not used for months as it was not needed untill cold weather so i suppose thats the replacement out of the question as that i think only a matter of weeks option.
When it was bought the sale guy never chirped up "oh and by the way how long is your chimney"
Its a normal house terrace type

I would suggest repeated and vociferous visits to the shop, preferably at busy periods - "Excuse me, but you still haven't rectified the issue with my 97 year-old granny where you sold her a gas fire which wasn't fit for the purpose...", "So, you're saying that before buying a gas fire from you, we have to do our own survey into what type of fire is suitable for our premises then?" etc.
It's amazing what a bit of embarrasment can yield.

My brother recently had a similar problem with a large electrical retailer when he bought a freezer that didn't work. They delivered it on a Sturday evening at 20.00 FFS. Brother unloads old freezer and puts in garden to take to tip the next day and after two hours realises the new one is not working because all the gas is escaping from a split in the compressor system.
Phones them up stating he wants to take the freezer back on the Sunday as his food is de-frosting. Shop say they can't take it because it their policy to have an engineer look at the item before they decide on replacement or refund. He spends a lot of frustrated time on the phone to various management staff but still gets the officail line "We will send an engineer. The next appointment available is Thursday"
Brother phones me up and asks can I help. Brother and myself load freezer into the back of his trailer at 1600 on Monday. He arrives with the freezer, deck chair, a packet of sandwiches, flask and a large book at 1945 hours at the shop, wheels the large freezer through the front door on a sack trolley and as he gets through the door an assistant says " You must be Mr XXXXX. I am very sorry but you can't leave that here because we have no policy for dealing with it. You need to have it looked at by an engineer".
Brother says " It is here now and so am I", unfolding deck chair in the front foyer area in the shop, getting out book and flask with sandwiches.
Assistant says " you can't stay here because we are shutting the shop in ten minutes"
brother says " Well its going to be a long night then because I am not leaving until I get a refund or a new freezer", and settles down to read his book. Lots of customers smirking as they are ushered out of store at closing time.
Assistant comes back and says " I have to ask you to leave now"
Brother says " you have my name and address, sue me for trespass then, I am going nowhere until Freezer or money exchange hands."
Assistant says. "we cannot take this item back because we have no way of testing it unless an engineer does it"
Brother says " If I bought a Telly and it did not work, would you exchange it without an engineer?"
Assistant "Yes"
brother "How can you do this then?"
Assistant "Plug it in and see if it works"
brother "Then plug the fcuking freezer in and see if it works! the gas comes out and it don't get cold"
Assistant "Sorry, I'm not allowed to do that."
brother "I'll tell you what, go and get the manager and I will talk to him."
Assistant "He's not here"
Brother "Then get me the most senior person you can"
Assistant. "What do you want to talk to him about?"
brother " Urrrrrrrm, The carpet!"
Assistant disappears and comes back with customer services manager who accepts the freezer, apologises profusely, exchanges for a new one and compensates for the value of food lost which had defrosted.
Persistance pays off and they got to close the shop 15 minutes late.

My brother got me and the family a new fridge freezer for christmas. Then they ring and tell us it is not in stock,... do we want to wait or order another one.
I tell them to deliver what we ordered cos if wee pick something else, that will be out of stock too.
This happened 3 times.
It arrived a couple of weeks ago.
We promised never to go back to 'Hale bop' but when my brother offered us a fridge, we buckled.
Should have known better.

my friend bought a computer that wouldnt work from a cheesy retail park shop, I parked my car IN the front double doors blocking it entirely. and shouted at the top of my voice "dont buy from these robbers" until they sent the manager, who tried to move my car, so I had him arrested for breaking and entry, and attempted theft.
computer didnt get fixed, but the shop went bankrupt a month later and the manager lost his job for a criminal record, so I was happy.

that has given me an idea
If I was to pull a similar stunt (probably with the same retailer)
a) can i get nicked?
b) can they attempt to manhandleme out of the shop?
1. You cannot get nicked for being a trespasser anywhere unless you do something else other than trespass at the same time. The only option is to appease you or sue you through the civil court. Just sitting there and refusing to move will not get you arrested. There is no power to move you.
If the shop becomes private premises, (by shutting) You become a squatter. The owners have to apply to a court to evict you. Anyone offering violence to you or the proeprty if you refuse them entry while you are in there, commit an offence of using violence to secure entry, unless they have a warrant issued by Magistrates to allow them to do so.
2.You may be asked to move but you can refuse and any attempt to physically move you will result in an assault with Battery
Reading, eating sandwiches and drinking coffee whilst a trespasser is mighty annoying the the shop owner, but they can really do nothing whatsoever to stop you, other than give you the service that you deserve. It takes a bit of bottle but can pay dividends.

Unless said shop owner's called Zed, drives a hog and has a penchant for military accoutrements and leather clad gimps in the cellar.
Assuming the CCTV's switched off, you'd be better advised 'hauling ass,' as they say, under such circumstances.
But I do think the very existance of squatting rights is one of the most ridiculous legislative carbuncles on the nose of our much maligned justice system.
Relying on them thus seems a tipple too little in the stoicism department, despite the circumstances.
But the people in these retailing 'sheds' often are unforgivable wasters.

I thought the answer was no to both

might take the kids with me to really drive the manager mad.

what would we do without your advice! that's excellent!

Rich,
Getting back to your problem with the gas fire.
It is the responsibility of the installer to ensure that the appliance is working properly and meets the gas safety regulations. I don't know if the fire is faulty or not, or if the problem is with the installation. But normally if the manufacturer has been to inspect and says that the fire is not at fault then the installer's work, flue or combustion air supply are more likely to be questionable.
I suggest you get back to the installer if you have not already done so and demand that they rectify the problem based upon the Baxi engineer's report that the fire in itself is not faulty. Incidently, the gas safety regulations are a statutory act and failure to comply is (I believe) a criminal offence unlike trespass which is a civil matter.
On the other hand there may be a blockage in the flue that occured after the fire was fitted - in which case it is not the installer's nor the retailer's fault.

Having a certain amount of fun with a builder/developer at the moment. Basically I bought a newly built flat and various things aren't done properly, like the double glazing isn't sealed so when it rains the water pisses through. In the process of getting NHBC to sort things, but 3 months down the line I'm getting nowhere.. Basically NHBC writes to them nicely, they get ignored, they threaten them with all sorts, (fines loss of registration, whatever) and get ignored, and I get nothing sorted.
Maybe if a couple of dozen of us take the direct approach and have a picnic at 4.45 in their office..
Must admit, my 1st thought was to find a friendly farmer and pay them to deliver a nice well ripened load of manure at 7.00 on a Monday morning.. I suppose that could be counted as littering though..
If not, time for revenge methinks..
