Can anyone help with this question please? Some time ago I reversed into another car, no damage to mine very slight damage to other car. The other party weren't interested in settling the claim but insisited on going through the insurance company, fair enough, except suddenly the damage had increased to 'the front of the car is all crumpled and may be a write off and I hurt my back' (verbal communication over phone when I suggested we sort it out without a claim. My husband went straight round to their street and took photos of a remarkably non damaged car (scratches and dent on car wing - not where I hit it!) and forwarded them to our insurance company. I didn't put a claim in as I had no damage.
Several months later the other party had their car repaired , waiting until school holidays apparently, despite our protestations our insurance co paid up for all damage claimed by them, presumably it's easier to pay a small amount then argue the case. Anyway because my insurance was due to be renewed and because of the accident went up more than the damages cost I decided to pay the insurance co the cost of the damages and retain my no claims. As an honest person this has really wound me up that someone has in effect stitched me up to get old damage repaired. What can I do? Will the police be interested or is it a civil case. I've written to both the person and their insurance co and had the person report me to the police for harrassment (due to one very polite letter asking for a portion of my money back) and the insurnace co basically told me to get lost.

I would be very interested in reporting it to the police. Sadly I fear they will be very uninterested.

Not in my sphere but intrigueing...

Sounds as if fraud is present but just who is the victim?.

Insurance Comp it would seem but they are not interested in pursuing which, I would suspect, gives Plod a get out.

Don't think the insurance co is the victim DVD if the OP has repaid the cost of the claim to keep the preium down... they win either way so as you say why should they care - the OP is the victim either way...

yes but the OP would be loaded even if the damage was light (as described).
i think the insurance company would load you if you had an accident even if there were no claims from either party.

I feel as that I'm the victim because someone has cheated me, they perhaps think it's ok to get a bit extra out of an insurance co but I'm £350 down not alot I know but it's the principle.

Absolutely Right.

Please do report it. A few more people of principle in the country and we might actually put the Great back into Great Britain.

Did the third party claim for injured back? If they did then they should have reported this to the police at the time of accident.

Hang on - £350? That's not a 'the front of the car is all crumpled and may be a write off and I hurt my back' type on incident.

Someone nudged the back of my wife's Jazz a few wks ago - the other car looked undamaged but the impact pushed one the Jazz's bumper mounting partly through the bumper (so the surface bulged out a little). The lady that did it thought it was fine, and if not, her partner 'knows about cars and he can patch it up'. Err..no thanks. Honda dealer fitted a new bumper and that cost..£350. And it was only that cheap because they (remarkably) come ready painted from the factory.

It was an old micra market value about £400 max I get the feeling they had 'damages' repaired up to a limit before the car was classed as a write off. We know a chap that works at the garage that repaired the car, he looked through the records unoffically for us and told us that unusually there wasn't a photo of the car/damage in the records. I think that somehow they managed to get £350 worth of damage repaired so they had a better chance of an injury claim. However hey dropped the injury claim perhaps they realised you actually have to prove an injury!

I know it's a bit gutting but it's just tough. You bumped their car and they got what they could out of it - plenty of other people would do the same. The bill on many other cars sould have been *much* larger.

If my wife had damaged our Jazz herself then maybe I could have patched it up, or even bought a new bumper on eBay. But someone else did it so I just let the insurance sort it out.
