My only employee has have had a letter from HMRC telling her that in the 2004/5 tax year her P14 shows an overpayment of £130 in PAYE and seeking an explanation from the employee.

I am struggling to find the P14 copy, and can't get acess to the 2004/5 year via their web site ( I have every year except this one but we submit annual returns online and I thought 2004/5 would have been done and dusted).

Do you think they will accept that we simply must have miscalculated and hand over the £130 to her or will they demand something more than this?

My worry is that this is a sign they are digging about in our old P14/P35 returns.

As an employer you are required by law to keep your PAYE records., One of the dangers of filing online is that paper copies may not have been taken - which can result in it being very difficult to find the necessary data if needed at a later date.

Have the Revenue offered any explanation as to why the employee might have overpaid her tax ?

Does the employee have her P60 for 2004/05 - which would show the same information as the P14.

In fact, if you look at the summary of salaries print-out for 2004/05 (if one was actually run off at the time)or the P11 summary, you might have the same information in those records.

The annoying thing is I have all of the P11/P14's from every year except this one and the envelope carefully labelled as containing them has every year except that one. furious It must be there somewhere.

I will have a record of the monies paid to the employee and the tax man on her behalf, so I can see if the gross figure they claim is correct.

I am not sure if I should write on her behalf or whether she should respond as she can offer no explanation other than 'he did it'. I think it may be a computational error as at that time we were still working from the hand cranked tables before we started to use the HMRC CD based calculators and I never did get a hang of the 10% tax band 9 despite a 2hour session with the local tax lady).

Also nice to note that they're only 2 years behind with you. I got a query yesterday about 2003/4. WTF do these people do with this stuff - put in a drawer and forget it for a while?

That was my concern: that this had come up because they were delving into the dim and distant past for some reason. Perhaps they are just bleedin' useless?

Have written to HMRC saying i cocked it up before I used the CD calculators and offered to pay her the interest on her £130 since 2004. Hopefully HMRC will just go away and give her the 3130.
