County Court Judgements

Can I issue a claim against someone whose name and address are not known to me, so that if I do encounter them again I can use the judgement against them?
When you are intending to issue a claim against someone, you are doing this as a last resort as they owe you money and wont pay.
This is done by 'inviting' them to come to court so that you can prove they owe the money. Once that is proven (or they dont turn up) you can then instuct bailliffs etc to get your money back.
However this would be pointless if you dont know who the person is or who they are, more pertinently you would not be able to issue a summons unless you know who and where they are!
If you can find their name and address you can then go down that path.
Ok, fair enough. Was asking as the police said that as far as they were concerned I would have to deal with some theft myself. As for meeting the person again, I would expect to meet them around once a year, and would easily recognise them (they look like Fred Dibnah). Suppose I'll have to sort it out manually.

CC bailiffs are a waste of money. All the other party has to do when they call is to deny that anything belongs to him (or her)and the bailiffs go away having trousered the fee you paid up front. Found that out the hard way.
Uh, you can ask the court to order the defendant to provide information pertaining to their assets...IF they lie, perjury is a bad thing....

I thought bailiffs kept going back though, till they got the money, surely the other party will have some goods that can be removed.
Loved reading the story about the lady that claimed her bank charges back, won in court, then sent the bailiffs into Natwest to claim the £X thousand pounds she won. Funny as hell.

You can only send in the bailiffs if the debtor hasn't paid within x period of time, IIRC 14 days.
And yes, they can go back time and again. And they can also clamp the car outside until such time as the true owner proves it is theirs and not the debtors (assuming it is on the drive etc..).

With some more info about what your dealing were with him and the circumstances I think myself and otheres could help some more. There is always a way of finding someone. Waiting a year may only give him the chance to cover his tracks or just deny the whole scenario.
