Non-porsche warranty issues - legal help needed?!!
Discussion
Morning all,
Ok strap youselves in this is gonna take a bit of typing ..
A month or so ago my variocam unit failed causing the usual syptoms so i get it replaced expecting as they did last time the warranty company to pay up. Now ive had a two previous claims from them being a variocam and starter motor. It now appears they are dragging thier heels. They have asked me to prove its broken. A porsche specialist on here volunteered (thankyou) to take the unit and test it independently and he has found its broken and sends me a letter to confirm this. I phone the warranty company and state this and the (rude) man on the phone starts saying well that doesnt prove its broken we want you to strip the unit down and prove that part x is broken.
Clearly they are taking the piss and just dont want to pay out (shock) so they are putting the onus on me. I/specialist didnt design the thing and we dont know the inner workings of soleniods or whatever!!
So i need to kick the warranty company. To this end anyhbody got any advice on trading standards/Citizens advice ... or can someone recommend me a lawyer (or is someone here a lawyer) that can write me a letter stating that i have proved its broken .. pay up ...
Whats my position here ...
Thanks in advance
Phil

If they will accept theit responsiblity to pay out if part X or Y or whatever is broken then are they prepared to suggest a way to prove whether thee parts are broken, whch you would be happy to agree to. Sounds like they just think therer is still wriggle room in the test that was done.
Sounds a bit early for legal stuff - its a right drag in my (limited) experience

Warrantee companies use inspectors. There is usally some liasion between your garage opening the area up and the inspector has a look. If they haven't suggested it, ask them to send their own inspector down.
Yer they have already inspected it but a variocam is very much a sealed unit that you cant explicitly see which bit is broken. Its just bust! They want me to get it stripped by an independent engineer so he can say part x is bust...
Thanks for the other comments all taken on board.
