On a dual cariageway, 12pm lunchtime, no other traffic within a mile.

Caught on scamera van (*^%?in9 b4st4rD5)

Will this be a 3 pointer or more?

You might get 3pts offered as FPN for administrative simplicity - it has been known - but mags guidelines for that sort of speed are a starting point of 4-5pts or up to 42 days ban.

Incorrect....

ACPO guidelines

Summons starts at 96mph. I once got a fixed penalty for 93mph (admittedly on a motorway rather than a DC, but the guidelines just specify a 70mph limit and don't differentiate between road types).

Of course they don't have to offer this, but since the scumerati (so well-described by the OP) only make cash from (paid) FPNs, it's a certainty IMHO. I assume that's what 7db meant by "administrative simplicity".

Regrettably the new Road "Safety" Bill will lower the thresholds (including the 79mph one at which they currently start prosecuting at all). What to is anyone's guess. I'm not sure I want to know. weeping

It should be 3 points and sixty pounds.

That's what I got for 95 in a 70.

Thats what it will be if you accept the fixed penalty.

On the other side of the coin for 92 on a 70 I was given 6 points and a £200 fine for having the audacity want to contest my innocence in court.

Very interesting - thanks. Are these guidelines used by camera vans in Scotland? ie would you get off at 78mph on a dual carriage way if filmed by a van?

As said before, the guidelines are positive instruction to do something at a threshold. They are not an instruction to not do something until that threshold reached. It is possible to be prosecuted at any proveable speed in excess of the limit, the Police just choose not to. The only way to be sure is to not exceed the limit at all.

If you can afford www.motoringlawyers.com fight it through them and you will win PS) dont send back the NIP.

In practice, however, not a single person on PH/Safespeed/Pepipoo has ever come up with a NIP for even 1mph below the guideline prosecution thresholds. There have been a few rumours but every single one has been unsubstantiated. Therefore, ec2, the answer to all intents and purposes is "Yes".

They don't do this out of the non-existent goodness of their non-existent hearts, they do it to avoid potential problems in court ("How can you be sure your equipment is accurate enough" etc). Besides, quite enough people drive at over the threshold for the scammers to continue their legalised theft without the need to start being even more audacious.
